ATTY/RESO.0033/PC RESO APPROVING A CONDITIONAL USE PERMIT & ARC – 860 CHARTER ST. <br />REV: 06-27-17 PR <br />Page 2 of 11 <br /> <br /> <br />WHEREAS, the Commission has determined that the proposed Conditional <br />Use Permit and Architectural Permit, for a new elementary school would not be <br />in conflict with the purpose and intent of the City of Redwood City General Plan, <br />and is in accordance with the applicable provisions of the Redwood City Code and <br />Redwood City Zoning Ordinance. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING <br />COMMISSION OF THE CITY OF REDWOOD CITY AS FOLLOWS: <br /> <br />Section 1. The Planning Commission finds that the above recitals are <br />accurate and constitute findings in this matter and, together with the Staff Report <br />and the application materials, development plan, the IS/MND, and all other <br />documents, reports, studies, memoranda, maps, oral and written testimony, and <br />materials in the City’s file for the applications and the Project, and all adopted <br />City planning documents relating to the Project and the property including the <br />City’s General Plan, Municipal Code, Zoning Ordinance, and other applicable City <br />laws and regulations, have together served as an adequate and appropriate <br />evidentiary basis for the findings and actions set forth in this Resolution. <br /> <br />Section 2. Conditional Use Permit (UP2014-20) Findings (Zoning <br />Ordinance Sections 42.4 and 33.19) for continuation of legally nonconforming <br />parking stall size and driveway width: The Planning Commission finds that: <br /> <br />a. The proposed use will be consistent with the various elements and <br />objectives of the general plan and any applicable Specific and Precise <br />Plans, and zoning regulations for the subject location in that the Project <br />meets the applicable criteria in the Industrial Restricted (IR) zone district <br />and is consistent with the Light Industrial General Plan land use <br />classification. <br />b. The proposed use is compatible with surrounding uses in that the project has <br />been designed to minimize traffic impacts by designing drop-off and pick- <br />up operations on-site and has included landscape screening to reduce <br />views of the playground. <br />c. The use and its associated structures and facilities will not be detrimental <br />to the public health, safety or welfare of the people and property of Redwood <br />City. As discussed in the IS/MND, the Project would not be detrimental <br />to the public health, safety or welfare of the people and property of Redwood <br />City. The school will implement a traffic control program designed to <br />accommodate pick-up and drop off traffic onsite, thereby reducing potential <br />safety conflicts in the public right-of-way. Neither the Project, nor the <br />implementation of conditions of approval or mitigation measures, will be <br />detrimental to public health in the immediate environment of the school or to <br />the general welfare of the City, in that those conditions are intended to <br />reduce impacts as a result of school operations.
