3. PUBLIC HEARING - appeal of Planning Commission <br />9 g <br />y I�en��ti�g� omegwner's h na <br />Curia, appellant, <br />Affidavits of Publication of Notice of Hearing and mailing are on file. <br />Report: Planning Commission Report to Council 7/24/89 <br />Senior Planner Charles Jany presented the staff report with slides and <br />overheads in support of denying the appeal stressing the development's <br />original intent to have a high quality stone wall of varying height along <br />Kentfield Avenue, except for emergency gates, to provide streetscape <br />continuity and avoid a "tunnel effect." <br />Mayor Greenalch declared the public hearing open at 8:19 p.m. and invited <br />anyone who wished to speak to do so. <br />Roger Whitney, 861 Whitehall Lane, Redwood City, member of the Board of <br />Directors of the Kentfield Commons Homeowners Association spoke in favor of <br />upholding the appeal citing the need for conformity of fences throughout the <br />development for aesthetic reasons and the willingness of developer to build <br />6' fence which would discourage children and adults alike from jumping over a <br />fence for egress or ingress. <br />Steven Zweig, 213 Yarborough Lane, Kentfield Commons Homeowners Association, <br />spoke in favor of upholding the appeal, showed slides of current fences and <br />asked for 6' conforming fence to provide safety, security and appropriate <br />aesthetics. <br />Peter Tiernan, Attorney for developer Citation Builders, 100 N. Winchester, <br />Suite 2, Santa Clara, CA, advised Council Citation Builders had no objection <br />to either proposal. <br />Mayor Greenalch asked if anyone else wished to speak on this subject. No one <br />else wished to speak. <br />M /S: Bury /LaBerge to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8 :40 p.m. <br />M /S: Claire /Buchan to uphold appeal with the exception that a 6' fence, <br />open wrought iron with colors to be determined, begin at the 15' setback on <br />both sides across from the adjacent house. <br />During discussion it was suggested that the appeal be upheld without <br />specifics, that the City, developer and Kentfield Commons Homeowners <br />Association work together to resolve the issue, and that the City retain <br />jurisdiction in this matter. <br />Councilman Claire who made the motion and Councilwoman Buchan who seconded <br />the motion agreed to amend the motion.
