of acts of God, accidents, breakage, strikes, lockouts, other labor disputes, enemy action, civil <br />commotion, protests, riots, demonstrations, federal or state governmental restrictions, or by any <br />other reason beyond the reasonable control of Licensee. <br />(i) Restoration of License Area. Immediately following completion of any work <br />permitted hereunder, Licensee shall remove all debris and any excess dirt and shall restore the <br />License Area to its condition immediately prior to Licensee's work hereunder, to the satisfaction <br />of City. Licensee shall restore any damage caused to existing roads and restore excavated areas <br />with new vegetation (including irrigation and maintenance until established) and erosion control <br />netting, all as requested by City and shall comply with all applicable regulations of the regulatory <br />agency with jurisdiction. <br />(j) Piaeline Denth/Installation of Above -Ground Markers. Before commencing <br />any excavation work in the License Area, Licensee shall measure the depth of City's pipelines, if <br />any, located in the License Area by potholing and shall forward such information to City. The <br />potholing authorized by this License shall be subject to the direction of the Construction <br />Inspector. Potholing using of soft dig method (vacuum soil extraction system) is preferred. If <br />Licensee wishes to use any other mechanical method such as digging with a backhoe, Licensee <br />must submit a request to City in writing at least five (5) business days prior to the proposed <br />commencement date and obtain SFPUC's prior written consent, in City's sole discretion. <br />Notwithstanding the foregoing, the last two feet (2') of soil above the top of any City pipeline <br />must be dug manually, without the use of any machines. Upon completion of work, Licensee <br />shall promptly notify the City in writing of the depth of the City's pipeline and related facilities <br />in the License Area. Licensee shall install above -ground markers identifying the location of any <br />underground facilities installed pursuant to this License. The location, type and installation of <br />markers and identifying information on the markers shall be subject to the prior written approval <br />of SFPUC. <br />(k) As -Built Drawines/Reoorts. Promptly upon completion of the installation of the <br />facilities, Licensee shall furnish SFPUC with two (2) complete copies of final as -built drawings <br />for the facilities, which drawings shall include sufficient detail so as to allow City to precisely <br />locate the facilities. In the event that Licensee or its Agents or consultants prepares any <br />environmental, seismic, geophysical or other written report relating to the License Area and/or <br />any work performed thereon, Licensee shall furnish to City a complete copy of such report, <br />including any schedules, exhibits and maps, promptly upon completion of the same. <br />(1) Responsibility for Maintenance of Facilities. Licensee shall be solely <br />responsible for repairing and maintaining all facilities placed in or on the License Area pursuant <br />hereto in good and safe condition, and City shall have no duty whatsoever for any repair or <br />maintenance of the License Area or any such facilities therein. Licensee shall notify City in <br />writing not less than five (5) days before performing any repair or maintenance work in the <br />License Area, except in the case of an emergency wherein Licensee shall notify City <br />telephonically and in writing as soon as reasonably possible. <br />(m) Revocabilitv.
