(n) Contractors. Licensee shall not accept and release its contractor for work <br />authorized or required by this License before securing the SFPUC's written approval. <br />(o) Cathodic and Other Protection. City may adopt from time to time such rules <br />and regulations with regard to Licensee's facilities and operations hereunder as City may <br />determine are necessary or appropriate, in City's sole discretion, to safeguard against corrosion <br />of, or other damage to, City's pipelines and related facilities. Licensee shall immediately comply <br />with all such rules and regulations upon receipt of a copy thereof. <br />(p) Tvne of Pine. Licensee shall use steel, ductile iron or cast iron pipe for the entire <br />right-of-way crossing. <br />(q) Distance between Pines. The clear distance between the bottom of Licensee's <br />facilities and the top of City's existing and any proposed future water lines shall not be less than <br />twelve inches (12") and Licensee's installed facilities shall be placed at a constant grade for the <br />entire crossing over the License Area. <br />(r) Potholing. The potholing authorized by this License shall be subject to the <br />direction of the City's inspector. Potholing using the soft dig method (vacuum soil extraction <br />system) is preferred. The use of other mechanical methods such as digging with a backhoe must <br />be approved by SFPUC at least five (5) days prior to commencing such work. Notwithstanding <br />the foregoing, the last two (2) feet above the top of the pipe must be dug manually, without the <br />use of any machines. <br />6. Restrictions on Use. Licensee agrees that, by way of example only and without <br />limitation, the following uses of the License Area by Licensee, or any other person claiming by <br />or through Licensee, are inconsistent with the limited purpose of this License and are strictly <br />prohibited as provided below: <br />(a) Imorovements. Except as otherwise expressly provided herein, Licensee shall <br />not construct or place any temporary or permanent structures or improvements in, on, under or <br />about the License Area, nor shall Licensee make any alterations or additions to any of existing <br />structures or improvements on the License Area, unless Licensee first obtains SFPUC's prior <br />written consent, which SFPUC may give or withhold in its sole and absolute discretion. For <br />purposes hereof, asphalt, concrete and cementitious concrete driveways, sidewalks and parking <br />areas, shacks and storage facilities, and fences shall be deemed "improvements." <br />(b) Trees and Other Plantings. Licensee shall not plant any trees or other <br />vegetation in or on the License Area, except as otherwise expressly provided herein and except <br />in accordance with detailed plans consistent with the SFPUC's Vegetation Management Policy, <br />which may be amended from time to time and as approved by the SFPUC in writing in advance. <br />(c) Dumping. Licensee shall not cause or permit the dumping or other disposal in, <br />on, under or about the License Area of landfill, refuse, Hazardous Material (as defined below) or <br />any other materials, including but not limited to materials that are unsightly or could pose a <br />hazard to the human health or safety, native vegetation or wildlife, or the environment. <br />(d) Hazardous Material.
