<br /> DES:dft 3/95 (014/67) <br /> 4. CONFIRMATION OF AMOUNT. Upon completion by City of the <br /> construction and installation of the fire service facilities to <br /> be funded by the grant made hereunder, City's Director of <br /> Community Development shall confirm, in writing, the exact amount <br /> of the expenses incurred by City to be credited with said grant, <br /> which amount shall be deemed the express amount of the grant and <br /> shall be that amount reimbursable pursuant to paragraph 3 hereof. <br /> 5. NON-DISCRIMINATION. Art Center hereby warrants and <br /> agrees that it does, and shall, conduct and operate its visual <br /> arts center to be located at the Property on a non-discriminatory <br /> basis, with equal treatment and access to its facility without <br /> regard to age, race, color, sex, national origin, medical <br /> condition, disability, sexual orientation, medical status, <br /> religious or political preference, or labor organization <br /> affiliation. <br /> 6. PARTIES' STATUS. In the performance of the obligations <br /> hereunder, Art Center and Owner shall be, and each of them is, an <br /> independent contractor, and neither shall be deemed to be an <br /> employee or agent of City. <br /> 7. CONTINUING COVENANTS. Art Center hereby agrees and <br /> covenants to perform and carry out all those certain obligations <br /> described under the heading "Programmatic Agreement" in Exhibit <br /> A. Art Center's obligations under this paragraph shall continue <br /> and remain in effect for a term concurrent with Art Center's <br /> lease term, or any renewal thereof, for Art Center's activities <br /> located at the Property. <br /> 8. HOLD HARMLESS. Art Center and Owner, and each of them, <br /> agree to defend, indemnify and save harmless City, its Council, <br /> 3 <br /> - ',-- <br />
