<br /> DES:dft 3/95 (014/67) <br /> parties acknowledge and agree that said connection pertains to <br /> the installation and construction of a fire service water line <br /> from City's water main located in Winklebleck Street to the <br /> Property. <br /> 2. PURPOSE. The parties acknowledge that the grant made <br /> pursuant to paragraph 1 is made by City for the purpose of <br /> advancing art and cultural activities in the City of Redwood <br /> City. Therefore, Art Center covenants and agrees that, as a <br /> condition of the grant made hereby, it shall carry out those <br /> activities at the Property more specifically described under the <br /> heading "Programmatic Agreement" in Exhibit "A" hereof, attached <br /> hereto and by this reference incorporated herein. Art Center and <br /> City further acknowledge that the activities described in Exhibit <br /> A are identical to those set forth in Exhibit "c" of the Agency <br /> Agreement and that the grant made hereunder shall supplement that <br /> grant made under the Agency Agreement. <br /> 3. REIMBURSEMENT OF GRANT. Owner acknowledges that Art <br /> Center's use of the grant made hereunder benefits Owner's <br /> Property, but that the public purpose advanced by said grant <br /> pertains to the use of the Property by Art Center. Therefore, <br /> Owner agrees that Owner shall reimburse City for said <br /> improvements in the full amount thereof upon whichever of the <br /> following events sooner occurs: (i) expiration of the period of <br /> eight (8) years from the date hereof, to wi t : _r~~O gl"\\ , <br /> 2003; or ( ii) cessation of use of the Property by Art Center or <br /> any other non-profit corporation of the State of California which <br /> performs the activities described in Exhibit A. <br /> 2 <br /> ,- '1"'-""'" >................,--..-.. <br />
