<br /> METRIC OM shall comply with all applicable laws, ordinances, codes and regulations of <br /> the federal, state and local governments in connection with the work and SERVICES to be <br /> provided by METRIC OM pursuant to this AGREEMENT. <br /> PART II· CONSTRUCTION <br /> Section 1. PLANS AND SPECIFICATIONS. <br /> METRIC OM has submitted to the Community Development Department of CITY and <br /> CITY has approved certain plans and specifications for the PROJECT attached hereto as EXHIBIT <br /> "C," entitled "PLANS AND SPECIFICATIONS," and incorporated fully herein by this reference. <br /> METRICOM agrees to perform any work of the PROJECT at METRICOM's sole cost and expense <br /> and in accordance with and in a manner that the City Engineer (the "ENGINEER"), or the <br /> ENGINEER's designee, is satisfied conforms to the PLANS AND SPECIFICATIONS. Approval <br /> by CITY of the PLANS AND SPECIFICATIONS shall not release METRIC OM from the <br /> responsibility for or the correction of any errors, omissions or other mistakes that may be contained <br /> in the PLANS AND SPECIFICATIONS. <br /> Section 2. SCHEDULE OF PERFORMANCE. <br /> A. All work to be performed by METRIC OM under this agreement shall be commenced and <br /> completed in accordance with a mutually agreeable time schedule. <br /> B. METRICOM shall obtain all applicable permits and notify the Engineering Division of the <br /> Community Development Department of CITY at (415)780-7380 or other telephone <br /> number for that Division, at least forty-eight (48) hours but not more than one (1) week: (1) <br /> prior to the commencement of each phase of work to be performed by METRICOM under <br /> this AGREEMENT; (2) prior to resuming work under this AGREEMENT after an <br /> interruption in work that continues for more than two (2) working days; (3) prior to <br /> changing any component of the work schedule set forth in the SCHEDULE OF <br /> PERFORMANCE applicable to work to be performed by METRIC OM under this <br /> AGREEMENT; and (4) prior to canceling any work or the completion of any work to be <br /> performed by METRIC OM under this AGREEMENT. <br /> C. Notwithstanding PART I, SECTION 1, ENGINEER shall have the authority to modify the <br /> PLANS AND SPECIFICATIONS and the SCHEDULE OF PERFORMANCE to: <br /> (1) Change the pole locations listed on the PLANS AND SPECIFICATIONS; <br /> and <br /> (2) Change the number of poles listed on the PLANS AND SPECIFICATIONS to add <br /> pole locations, up to a maximum number equal to twenty percent (20 of the pole <br /> locations listed on the PLANS AND SPECIFICATIONS on the Execution Date, or <br /> to subtract pole locations, up to a maximum number equal to twenty percent <br /> redwood3.doc 5 <br /> 9/21/95 · <br /> ....... <br /> I <br />
