<br /> . <br /> OCL":;W i,~ <br /> hh.-,d ,I ..,. 5/24/95 <br /> AGltIIHIH:t <br /> LEASE AGREEMENT - COMMmnCATXONS SXTE <br /> (EMERALD LAKE HXLLS WATER TANK PROPERTY) <br /> THIS LEASE ("Lease"), dated 0u ~ 8 , 1995 is made <br />by and between the CITY OF REDWOOD CI , a municipal corporation <br />of the State of California ("Lessor" ) and SMART SMR OF <br />CALIFORNIA, INC. , a Delaware corporation, dba Nextel <br />Communications ("Lessee") . <br /> &B~Z1:ALa <br /> WHEREAS , Lessor is the owner of certain property situated in <br />San Mateo County, State of California, described in Exhibit "A", <br />attached hereto and incorporated by reference (the "Emerald Lake <br />Hills Water Tank Property") ; and <br /> WHEREAS , Lessee is a corporation organized under the laws of <br />the State of Delaware whose principal business is to provide <br />mobile radio/telephone service; and <br /> WHEREAS , Lessee requests use of a portion of that certain <br />Emerald Lake Hills Water Tank Property, as described in Exhibit <br />"B", attached hereto and incorporated by reference (the "Leased <br />Premises") i and <br /> WHEREAS , Lessor is willing to permit Lessee to lease the <br />said property in accordance with the terms, conditions and <br />covenants of this Lease . <br /> NOW, THEREFORE , THE PARTIES AGREE AS FOLLOWS: <br /> 1. PREMISES.
