<br />to house, without limitation, its radio transmitting and <br />receiving equipment and back up power batteries, and to install <br />the other improvements as described in Paragraph 5.05 below. <br />Lessor and Lessee hereby agree that the Leased Premises including <br />any Access Areas (defined herein) may be surveyed by a licensed <br />surveyor at the sole cost of Lessee, and such survey shall then <br />supplement Exhibit B, and become a part hereof and shall control <br />to describe the Leased Premises and Access Areas in the event of <br />any discrepancy between such survey and the description of the <br />boundary of the Leased Premises contained herein. <br /> 2. :J.:IBH . The term of this Lease (the "Term" ) shall be <br />five (5) years commencing on August 1, 1995, or when Lessee <br />obtains the necessary building permit(s) to construct the Lessee <br />Facilities, whichever occurs first, (the "Commencement Date") and <br />terminating on the fifth anniversary of the Commencement Date, <br />unless earlier terminated as provided in this Lease. By written <br />notice given to Lessor no later than ninety (90) days prior to <br />the expiration of each term, Lessee shall have the option to <br />renew this Lease for a five (5 ) year period the ("Option Term") , <br />with the understanding that all terms, conditions and <br />requirements of this Lease shall continue in effect during the <br />Option Term. <br /> 3. RENTAL . Lessee shall pay to the Lessor as rent during <br />the Term and the Option Term for the Leased Premises in advance <br />--/ the and each anniversary date thereof <br />on Commencement Date on <br />without deduction, offset, prior notice or demand, in lawful <br />money of the United States, the sum of Thirteen Thousand Five <br />Hundred and NO/lOa Dollars ( $13 , 500) .
