<br />nuisance in, on or about the Leased Premises or permit or suffer <br />the Leased Premises to be used for any unlawful or immoral <br />purpose, or (b) do or permit to be done anything in any manner <br />which unreasonably disturbs the occupants of neighboring <br />property, or (c) interfere with or disturb in any way 1) the <br />operation of Lessor's system or tank site, 2) radio communication <br />system linked to telemetry controls at various tank and pumping <br />facilities, 3) any future facilities or operations that may be <br />implemented by Lessor. In the event that Lessee causes any <br />interference prohibited by this Paragraph and it is not promptly <br />resolved, this Lease shall thereupon terminate. <br /> 4.03 Approval by the City and Ot.her A.gencies. As a <br />condition precedent to Lessor's obligation to tender the Leased <br />Premises to Lessee, Lessee shall obtain the prior approval of the <br />City and such other governmental agencies and bodies that may <br />have jurisdiction over use of the Leased Premises by Lessee to <br />make the improvements specified in Paragraph 4.01 and to conduct <br />the acti vi ties permitted under this Lease. Prior to use of the <br />Leased Premises, Lessee shall obtain all required permits, <br />licenses and approvals from the City and any other governmental <br />agencies having jurisdiction over Lessee's use of the Leased <br />Premises. As a condition of this Lease, Lessee shall maintain <br />such permits, licenses and approvals in force throughout the term <br />of this Lease, including the Option Term in the event the Lease <br />--/ <br />is extended. Lessee shall be solely responsible for conducting <br />any environmental review required to be undertaken in association <br />with Lessee's use of the Leased Premises and for any and all <br />costs associated therewith, as well as any and all fees, charges, <br />or other expenses that may be imposed by the City or other <br />G:\SITES\LEASING\S99A \CITYLSE.DOC SITE #S99A 4 <br /> --¡...,.-. - <br />
