6.1.E. - Page 21 <br />Written requests for interpretation or corrections must be received by the City no later than <br />Wednesday, March 8, 2017 at 3:30 p.m. PDT. Requests received after the date and time stated <br />will not be accepted. <br />8. NEW MATERIAL - ACCEPTANCE <br />The units herein specified shall be constructed throughout of new parts and materials, which <br />shall have seen no service other than that necessary for factory tests, unless otherwise allowed <br />in the Bid Specification. Items purchased hereunder will be subject to final inspection and <br />acceptance at delivery destination as set forth in this Notice Inviting Bids. <br />9. LOWEST RESPONSIBLE BIDDER <br />In order to promote the policy declared above, contracts will be awarded only to such Bidders <br />as are determined to meet the following qualifications of lowest most responsible Bidder. <br />The award may be to the lowest most responsible Bidder or other Bidder. In determining who <br />the award is to be made, the awarding authority may consider, in addition to the Submitted <br />Bid received, the experience of the Bidder for the particular service sought, the quality of <br />work that the Bidder has done, the quality of the product or materials provided by the Bidder, <br />the ability of the Bidder to complete the project in a timely manner, the safety compliance <br />record of the Bidder, and the insurance carried by the Bidder. <br />10. AWARD OF CONTRACT OR REJECTION OF BIDS <br />The City reserves the right to amend or reject any or all bids and also to select, modify, or <br />reject any of the bid items as the City sees in its best interest. <br />Whenever quantities of individual items are involved the City reserves the right to make single <br />awards or separate items in an aggregate of several items to various vendors. <br />11. GUARANTEE <br />The Bidder warrants and guarantees that all equipment, materials, vehicles or supplies used <br />or furnished and all workmanship are of the type and quality specified herein. The Bidder <br />further guarantees that any latent fault in construction or defective material discovered within <br />one year after acceptance of the work shall be remedied by Bidder without cost to the City, <br />upon written notice given to Bidder. Other subsequent latent defects shall be covered by <br />responsibilities set forth in the law. <br />In the event of failure to comply with the above-mentioned conditions within a reasonable <br />time after notice, the City will have the defects repaired and made good at the expense of the <br />Bidder, who agrees to pay the costs and charges therefore immediately upon demand. <br />The signing of this agreement by the Bidder shall constitute agreement to the above <br />guarantees. <br />12. WARRANTY <br />Bidders should specify in their Bid Submission: <br />a. Details surrounding the manufacturer's standard warranty on all materials. <br />b.
