<br /> Page 8 <br />the County perform and City shall be responsible for costs for the item or items as set forth in Part <br />III, Section 4. <br />If a condition exists within the Library or common areas which, in the opinion of City <br />represents a hazard or threat to the public health or safety, City shall notify County (if said hazard <br />or threat to public health or safety is a maintenance responsibility of County) in writing and request <br />immediate repair or correction. Within ten (10) days of receipt of such request, County shall advise <br />City, in writing, that County will immediately undertake the required repairs, or that County disputes <br />the existence of a hazard or threat requiring immediate repair or disputes that it is County's <br />maintenance or repair responsibility. In the event that County declines to make the requested <br />repairs, City shall have the right, at its cost, and upon five (5) days written notice, to make the <br />requested repairs. City may seek reimbursement of the cost of such repairs, in any manner <br />authorized by law, on the grounds that the condition which was repaired constituted a threat to the <br />public health or safety which required immediate action and that City believes it was a County <br />maintenance responsibility. <br />No offensive or refuse matter, nor any substance constituting an unnecessary, unreasonable <br />or unlawful fire hazard shall ever be permitted to accumulate or remain at the Premises. The <br />Premises shall be kept at all times in an orderly manner to the reasonable satisfaction of County. <br />7. DAMAGE OR DESTRUCTION. In the event of a partial destruction (less than one-third of the <br />replacement cost) of the HSA/Library Building during the term hereof, from any cause, County shall <br />forthwith repair the same, provided that such repairs can be made within one hundred twenty (120) <br />days under existing governmental laws and regulations, but such partial destruction shall not <br />terminate this Agreement. If such repairs cannot be made within one hundred twenty (120) days, <br />County, at its option, may make the same within a reasonable time as agreed upon by City and <br />County, this Agreement continuing in effect. <br />In the event that the HSA/Library Building is destroyed to an extent of one-third or more of <br />the replacement cost thereof, City or County may, without consent of the other party, elect to <br />terminate this Agreement by written notice to the other party. A total destruction of the HSA/Library <br />Building shall terminate this Agreement. <br />8.
