.'.-., Page 12 (iii) Architectural and Engineering Fees. City shall pay for actual costs of architectural and engineering incurred by County for the Library space. Upon execution of this Agreement these fees were estimated at $36,000. Upon execution of this Agreement by City the amount of $36,000 shall be immediately due and payable by City to County. Upon completion of the building remodel County shall prepare a final accounting of the architectural and engineering fees incurred for the Library and shall bill City for the actual costs of these fees. Said bill shall be due and payable by City within thirty (30) days of receipt by City, (iv) Cost of Parking/grounds Improvements. City shall be responsible for the cost of modifying the existing driveway on its Parcel. County shall be responsible for costs associated with the construction of the common driveway and modification of its existing driveway. County shall be responsible for costs associated with County's parking lot improvements, improvements to the buffer area and improvements for the emergency exit ways and all work within the area designated "Limit of County Work" on Exhibit "A". (v) Cost of Maintaining Parking/grounds. Responsibility for the costs of maintaining the parking areas and grounds is set forth in Part I, Section 2 of this Agreement. 6. INCREASED CONTRIBUTION TO CITY BY COUNTY FOR OPERATION OF LIBRARY. The County Library shall increase its annual contribution to Fair Oaks Library operating costs by $21 ,000, or from $73,600 to a base contribution of $94,600, effective FY 95/96. Said annual increased base contribution of $94,600 shall be for a period of 5 years with the last increased contribution to be made in FY 99/00. For FY 96/97 through 99/00 the base contribution of $94,600 shall be increased or decreased at the same rate as the change in the County Library's base property tax income for the previous year. Said contributions shall be made from County to City on a quarterly basis. County and City shall renegotiate the County's contribution to City for the operation of the Fair Oaks Library at least six (6) months prior to the end of FY 99/00. 7. BUDGET. City and County hereby covenant to take such action as may be necessary to include and fulfill their obligations herein, respectively, due hereunder in each fiscal year in their budget for such fiscal year, and further covenant to make the necessary appropriations for all such payments. The covenants on the part of City and County herein contained shall be deemed to be and shall be construed to be ministerial duties imposed by law and it shall be the ministerial duty of Rwe HSA/Ubrary Agreement - Part III _.....~'.......,-..,..,._.~...,-~_..."...~ "
