<br /> .. <br />7. The City/District shall cause any and all agreements between the City/District and <br /> the Contractor or Contractors to be compatible and consistent with this <br /> Agreement. Each of the agreements shall include waiver of subrogation and shall <br /> expressly recognize the Project Manager as the City/District's agent in providing <br /> the Construction Manager's Basic and Additional Services specified in this <br /> Agreement. <br />8. At the request of the Project Manager, sufficient copies of the Contract <br /> Documents shall be furnished to the Project Manager to permit the 'timely <br /> performance of services, by the City/District at the City/District's expense. <br />9. The City/District shall, in a timely manner secure, submit and pay for necessary <br /> approvals, easements, assessments, permits and charges required for the <br /> construction, use or occupancy of permanent structures or for permanent changes <br /> in existing facilities. <br />10. The City/District, its representatives and consultants shall ordinarily communicate <br /> with the Contractor through the Project Manager. Nothing contained in this <br /> agreement shall preclude City/District from communication directly with any <br /> contractor retained by City/District in matters relating to Contractor's performance <br /> under its agreement with City/District. <br />11. The City/District shall send to the Project Manager and shall require the Design <br /> Professional to send to the Project Manager, copies of all notices and <br /> communications sent to or received by the City/District or Design Professional <br /> relating to the Project. During the Construction Phase of the Project, the <br /> City/District shall require that the Contractors submit all notices and <br /> communication relating to the Project directly to the Project Manager. <br />12. The City and District shall each designate an officer, employee or other authorized <br /> representatives to act in the City/District's behalf with respect to the Project. The <br /> City's representative for the Project is Peter Griffiths. The District representative <br /> for this project is Jeff Keuscher. This representative shall have the authority to <br /> approve changes in the scope of the Project and shall be available during working <br /> hours and as often as may be required to render decisions and to furnish <br /> information in a timely manner. <br /> Page 2 of 2 <br /> ..........
