Joe Brenner, Field Representative of,SEIU, Local 715, urged Council to adopt <br />resolution approving membership in PERS tonight and agree that administrative <br />costs should not be deducted from cap, but from the unused health funds <br />remaining at the end of the year, with the remainder going to the general fund, <br />assuring the Council there are sufficient funds to pay the administrative costs <br />in this manner. SEIU is ready to sign immediately if administrative costs can <br />be paid as requested. <br />Rick Kehr, representative of IAFF, Local 2400, advised that the IAFF was <br />willing to sign side letter to MOU if administrative costs not included, which <br />would reduce the cap of $280, and that the side letter contained specific <br />language not mentioned at the July 24, 1989 Council meeting when Council listed <br />the seven conditions of acceptance. <br />Joe Rodriguez, President of the Police Officers Association, expressed <br />support for the other bargaining units and advised the POA was willing to sign <br />the side letter to the MOU if administrative costs were not deducted from cap. <br />Council reminded all the bargaining units that it had responded at the July 24, <br />1989 Council meeting in a positive manner to their direct request to obtain <br />PERS health care benefits for their employees to meet the crisis caused by Blue <br />Cross discontinuing coverage, Bay Pacific financial woes, and threat of ABAG <br />termination, which came to pass last week, and to avoid any delay of the meet <br />and confer process. PERS was offered to all bargaining units with seven <br />conditions on a one -time and all or nothing basis with the promise of each <br />bargaining unit being able to negotiate adjustments during the collective <br />bargaining process. Council expressed its dismay that at this final hour, with <br />the resolution and motions on the consent calendar, that each bargaining unit <br />chose to renege on their original letters stating they were ready to sign the <br />side bar letters, but now were requesting changes to one of the seven <br />conditions. <br />M /S: Claire /Murray at 11:00 p.m., to continue meeting no later than <br />11:30 p.m. Carried by unanimous voice vote. <br />Council, City Attorney and Human Resources Director discussed the available <br />options in light of the bargaining units request to change one of the seven <br />conditions of PERS membership; the absence of signed side letters to the <br />memoranda of understanding; the requirement of PERS to have certified <br />resolution in Sacramento by September 19th; and the impact of an indemnity plan <br />to cover ABAG subscribers. <br />M /S: Murray/ to refer back to staff because there are no signed letters <br />of agreement and offer a 12 -hour window of opportunity for bargaining units to <br />bring in signed agreements. <br />Motion died for lack of a second while modifications to the motion were being <br />discussed. <br />M /S: Claire /Buchan to adjourn meeting to 12:15 p.m. tomorrow, September 19, <br />1989 and allow bargaining units to submit signed side letters to memoranda of <br />understanding to Acting City Manager Jean by 12:00 noon; if signed side letters <br />Minutes MINUTE BOOK NO. 49 <br />9/18/89 Page No. 100 <br />Page 6 <br />
