<br />WHEREAS, the BAAQMD is required to fund eligible projects from counties where a <br /> . . <br />Program Manager has been designated and an acceptable application supporting the project(s) <br />recommended by the Program Manager is received by BAAQMD; and <br />WHEREAS, C/CAG has been designated, by previous resolution, as the overall Program <br />Manager for San Mateo County; and <br />WHEREAS, on April 14, 1995, CICAG approved eleven (11) projects for AB 434 <br />funding, totaling $554,865, and on October 10, 1996 approved an additional $62,683.99 to fund <br />the Marshall and Hamilton Streets Signal Project (hereinafter "Project") which is described in <br />Exhibit" A" hereto; and <br />WHEREAS, C/CAG determined that funding of these projects is the most appropriate and <br />cost-effective strategy currently available within the County for reducing motor vehicle emissions <br />and is consistent with the '91 CAP and section 4424 1 (b) of the California Health and Safety Code; <br />and <br />WHEREAS, in order to comply with AB 434 and meet the requirements of BAAQMD. <br />the parties have determined to set out their mutual obligations in a formal agreement; <br />NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br />1. Any and all Project activities undertaken by CITY which are funded, in whole or <br />in part, by AB 434 funds provided under this Agreement, shall be consistent with the AB 434 <br />Funding Agreement entered into by and between C/CAG and BAAQMD on February 7, 1996, <br />(hereinafter "Funding Agreement"), and shall be conducted in a manner which enables C/CAG <br />to meet its obligations as Program Manager, as specifically set forth in Section 2 of the Funding <br />Agreement. Specifically, CITY shall do all of the following: <br /> a. Maintain records relating to the Project and expenses incurred in <br />implementing the Project, and retain such records for a three year period following <br />completion of the Project. <br />~ - - - <br />
