EXHIBIT C (Page 2) 2, The Contractor agrees to permit access to his records of employment, employment advertisements, application forms, and other pertinent data and records by the State Fair Employment Practices Commission, or any other agency of the State of California designated by the awarding authority, for the purposes of investigation to ascertain compliance with the Fair Employment Practices section of this contract. a. The Contractor agrees to complete in a timely manner all workforce data forms requested by the County to show compliance with AffIrmative Action requirements. b. Remedies for Willful Violation (1) The San Mateo County Human Services Agency may determine a willful violation of the Fair Employment Practices provision of this addendum to have occurred upon receipt of a final judgment having that effect from a court in an action to which Contractor was a party, or upon receipt of a written notice from the Fair Employment Practices Commission that has investigated and determined that the Contractor has violated the Fair Employment Practices Act and has issued an order, under Labor Code Section 1426, which has become fmal, or obtained an injunction under Labor Code Section 1429. I (2) For willful violation of the Fair Employment Practices/Civil Rights provisions, the San Mateo County Human Services Agency shall have the right to terminate this contract either in whole or in part, and any loss or damage sustained by the San Mateo County Human Services Agency in securing the goods or services hereunder shall be borne and paid for by the Contractor and by his surety under the performance bond, if any, and the San Mateo County Human Services Agency may deduct from any money due or that thereafter may become due to the Contractor, the difference between the price named in the contract and the actual cost thereof to the state. Child Abuse Reporting. Contractor agrees to ensure that all known or suspected instances of child abuse or neglect are reported to a child protective agency as defined in Penal Code Section 11165 (k). This responsibility shall include: 1. A requirement that all employees, consultants, or agents performing services under this contract who are required by Penal Code Section 11166(a), to report child abuse or neglect, sign a statement that he or she know of the reporting requirement and will comply with it. 2. Establishing procedures to ensure reporting even when employees, consultants, or agents who are not required to report child abuse under Penal Code 11166(a), gain knowledge of, or reasonably suspect that a child has been a victim of abuse or neglect. i - ,- .....- ..........
