(2) The Contractor agrees to permit access to his records of employment, employment advertisements, application forms, and other pertinent data and records by the_State Fair Employment Practices Commission, or any other agency of the State of California designated by the awarding authority, for the purposes of investigation to ascertain compliance with the Fair Employment Practices section of this contract. a. The Contractor agrees to complete in a timely manner all work force data forms requested by the County to show compliance with Affirmative Action requirements as shown in Exhibit C. b. Remedies for Willful Violation. (i) The San Mateo County Human Services Agency may determine a willful violation of the Fair Employment Practices provision of this Agreement to have occurred upon receipt of a final judgment having that effect from a court in an action to which Contractor was a party, or upon receipt of a written notice from the Fair Employment Practices Commission that has investigated the Fair Employment Practices Act and has issued an order, under Labor Code Section 1426, which has become final, or obtained an injunction under Labor Code Section 1429. ~ (ii) For willful violation of the Fair Employment Practices/Civil Rights provisions, the San Mateo County Human Services Agency shall have the right to tenninate this contract either in whole or in part, and any loss or damage sustained by the San Mateo County Human Services Agency in securing the goods or services hereunder shall be borne and paid for by the Contractor and by his surety under the performance bond, if any, and the San Mateo County Human Services Agency may deduct fÌ'om any money due or that hereafter may become due to the Contractor, the difference between the price named in the contract and the actual cost thereof to the County. 7. Assignment and Subcontract A. Without the written consent of the Director of Human Services or her representative, this Agreement is not assignable in whole or in part. Any assignment by Contractor without the written consent of the Director of Human Services or her representative violates this Agreement and shall automatically terminate this Agreement. B. Contractor shall not employ subcontractors or consultants to carry out the responsibilities undertaken pursuant to this contract without the written consent of the Director of Human Services or her representative. C. All assignees, subcontractors, or consultants approved by the Director of Human Services or her representative shall be subject to the same terms and conditions applicable to Contractor under 5 - 1 - ---..-...."-, T'
