<br /> (2) The Contractor agrees to permit access to his records of employment, employment <br />advertisements, application forms, and other pertinent data and records by the_State Fair <br />Employment Practices Commission, or any other agency of the State of California designated by <br />the awarding authority, for the purposes of investigation to ascertain compliance with the Fair <br />Employment Practices section of this contract. <br />a. The Contractor agrees to complete in a timely manner all work force data forms <br /> requested by the County to show compliance with Affirmative Action requirements as shown <br /> in Exhibit C. <br />b. Remedies for Willful Violation. <br /> (i) The San Mateo County Human Services Agency may determine a willful <br /> violation of the Fair Employment Practices provision of this Agreement to have occurred <br /> upon receipt of a final judgment having that effect from a court in an action to which <br /> Contractor was a party, or upon receipt of a written notice from the Fair Employment <br /> Practices Commission that has investigated the Fair Employment Practices Act and has <br /> issued an order, under Labor Code Section 1426, which has become final, or obtained an <br /> injunction under Labor Code Section 1429. ~ <br /> (ii) For willful violation of the Fair Employment Practices/Civil Rights provisions, <br /> the San Mateo County Human Services Agency shall have the right to tenninate this <br /> contract either in whole or in part, and any loss or damage sustained by the San Mateo <br /> County Human Services Agency in securing the goods or services hereunder shall be <br /> borne and paid for by the Contractor and by his surety under the performance bond, if <br /> any, and the San Mateo County Human Services Agency may deduct fÌ'om any money due <br /> or that hereafter may become due to the Contractor, the difference between the price <br /> named in the contract and the actual cost thereof to the County. <br />7. Assignment and Subcontract <br /> A. Without the written consent of the Director of Human Services or her representative, this <br />Agreement is not assignable in whole or in part. Any assignment by Contractor without the written <br />consent of the Director of Human Services or her representative violates this Agreement and shall <br />automatically terminate this Agreement. <br /> B. Contractor shall not employ subcontractors or consultants to carry out the responsibilities <br />undertaken pursuant to this contract without the written consent of the Director of Human Services <br />or her representative. <br /> C. All assignees, subcontractors, or consultants approved by the Director of Human Services <br />or her representative shall be subject to the same terms and conditions applicable to Contractor under <br /> 5 <br /> - <br /> 1 - ---..-...."-, T' <br />
