<br />2004-2005 Cost Shared Sidewalk Repair Project
<br />Recommendation
<br />By Motion, ratify the annulment of the award of contract to J. W. Riley and Son, Inc., of
<br />Emeryville, CA, for the 2004-2005 Cost Shared Sidewalk Repair Project, in the amount of
<br />$279,500.00, and award the contract for the 2004-2005 Cost Shared Sidewalk Repair
<br />Project to, Vanguard Construction, Inc., of Oakland, CA (the second lowest bid) in the
<br />amount of $ 336,250.00.
<br />Background
<br />On May 25, 2004, the call for bids was duly advertised and staff sent the project
<br />specifications to ten qualified bidders. Four sealed bids were received and opened at the
<br />Office of the City Engineer on June 23, 2004.

<br />The project was awarded to J. W. Riley and Son, Inc. on September 13, 2004 following a
<br />thorough review of references. J. W. Riley and Son failed to return the signed agreement
<br />and did not provide the requested bonds within the 20-day period specified in the contract
<br />documents. Staff met with the contractor immediately following Council award and set
<br />expectations for the work to commeñce by early October. The Notice of Award was sent
<br />from Public Works Services on September 14, 2004, and the agreement was sent from the
<br />City Clerks office on September 15,2004. Public Works Services staff scheduled follow-up
<br />meetings on three occasions which were all canceled by the contractor. J. W. Riley and
<br />Son was given a final chance to turn in his contract submittals by Friday, October 30,2004,
<br />(45 days from the Notice of Award) but failed to provide the necessary documents. On
<br />November 1, 2004, the City Manager signed the letter annulling the contract and it was
<br />mailed to J. W. Riley on that date.
<br />Vanguard Construction's references have been checked and staff is confidentthattheywill
<br />complete the work according to specifications. The company worked for the City under a
<br />previous name, P&F Construction and performed work to ~pecifications.
