In accordance with the specifications of the 2004-2005 Cost Shared Sidewalk <br /> Repair Project Contract Documents, Section 00200, Instructions to Bidders, <br /> Section 1.19A, Failure To Execute And Deliver Documents, it states, "If the Bidder <br /> to whom the contract is awarded shall, following twenty (20) Days after such <br /> award, fail or neglect to execute and deliver all required Contract Documents, <br /> insurance certificates, and any other documents required herein, the City may, in <br /> it's discretion, proceed against the Bidder's surety bond, cashiers check or certified <br /> check, and the proceeds thereof may be retained by the City as liquidated <br /> damages for Bidder's failure to properly enter into the Contract Document. <br /> The following events demonstrate that the City set reasonable expectations for <br /> performance standards within the specifications, work completion in a timely manner, and <br /> how we attempted to initiate the contract. We have experienced repeated failed attempts <br /> to conduct meetings with your company to review the scope of work and agree upon <br /> scheduling dates. <br /> On 09/14/04 - Pre-construction meeting, it was agreed that you would have two weeks to <br /> deliver contract documents, and submittals for material samples and base rock for <br /> compaction curve analysis. In addition we agreed that the first phase of construction <br /> should begin on 10/01/04. <br /> On 09/15/04 - City Clerk's Office mailed out Contract Document Packet. The City Clerk's <br /> office confirmed on October 27,2004 (42 days) after the Pre-Construction Meeting, that <br /> the Contract Document Packet had not been received from you. <br /> On 10/13/04 - The City's Inspector, Mr. Charles Drechsler, contacted your office by <br /> phone in an effort to expedite the execution of the contract document packet. He also <br /> requested a work schedule and was told that you are, "...so busy right now, it would be <br /> OK if we didn't call until December..." You did agree to meet on 10/13/04 and on <br /> 1 0/14/04. Both meetings were cancelled at your discretion. <br /> On 1 0/19/04 - The City Clerk's Office contacted your office and talked with "Kiyana" <br /> requesting the status of the Contract Document Packet and was told, "Its right he~e, I will <br /> send it today." <br /> 10/27 -04 -Mr. Drechsler contacteq y.ou to let you know that unless the Contract <br /> Document Packet was received by the City Clerk before the end of the day (5:00 pm) on <br /> 10/29/04, that the City may pursue the cancellation of the contract. The City Inspector <br /> requested another field meeting and you instructed him to contact your Foreman, Ramon, <br /> directly. It was agreed that the field meet would take place on 10/28/04 at 9:00 am. <br /> 10/28/04 - After 9:00 am, Mr. Drechsler called your Forman, who requested postponing <br /> the meeting until 1 0:00 am. At 10:00 am, Mr. Drechsler again contacted your Forman, <br /> who stated that he was told not to meet until all the paperwork had been turned in. He <br /> referred to a conversation between you and Gordon Mann earlier that morning, regarding <br /> the completion of the Contract Documents. <br /> Page 2 of 3 <br />
