This firm agrees that it will not, without express written consent, procure any such services or purport to obligate Client to the payment of any fees, costs or expenses in connection therewith. (3) Compensation. Client agrees to pay the Law Offices of Herman H. Fitzgerald at the rate of $220.00 per hour for work rendered in connection with the above-entitled matter. {a} Costs of transportation, meals and lodging incurred in the representation of Client under this contract shall be reimbursed to Law Offices of Herman H. Fitzgerald based upon actual costs incurred and supported by detailed expense records. Client shall be responsible for all costs incurred in connection with this suit, including such items as expert witness fees, photographs, maps and documents, filing fees, jury fees, attor- ney's telephone and travel expenses, and other items of costs and expenses generally necessary for the preparation and presentation of the cases at trial. These costs and fees will be advanced by attorney and paid as billed. (b) Costs and expenses directly connected with the performance of this firm's duty under the contract, including but not limited to telephone calls, facsimile transmissions, photocopying and reproduction of documents, filing fees, jury fees, reporter's fees, costs of services borne by the Client shall be reimbursed upon submission of itemized statements from this Firm. {c} Total compensation for work performed, including reimbursable expenses, shall not exceed the sum of TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25,000.00) without the express written approval of Client. The firm shall inform Client when seventy-five percent (75%) of an amount equal to total compensation, including reimbursable expenses, has been expended and the parties shall adjust the total compensation in accordance with the services anticipated. {4} Method of Pavrnent. _,The compensation of this firm shall be paid by Client monthly, and within thirty days after the billing date, upon receipt of a detailed form of bill setting forth services performed, the amount of time spent and the actual date. This firm shall maintain adequate records of dates and times worked on these matters covered by this contract which records shall be opened at any reasonable time for inspection on behalf of Client.
