<br /> ARTICLE 25 - SAFETY <br />25.1 Both the City and the Union shall expend every effort to see to it that work is <br /> performed with a maximum degree of safety, consistent with the requirement to <br /> conduct efficient operations. <br />25.2 Each worker covered by this Memorandum agrees to comply with all safety rules <br /> and regulations in effect and any subsequent rules and regulations that may be <br /> adopted. Workers further agree that they will report all accidents and safety <br /> hazards to the appropriate management official immediately. Any worker having <br /> knowledge of or who is witness to an accident shall, if requested, give full and <br /> truthful testimony as to same. <br />25.3 The City has established a safety program in each department and two (2) <br /> representatives of the SEIU Unit shall serve on each departmental safety <br /> committee. One representative of the SEIU Unit shall serve on the Citywide <br /> safety committee. <br />25.4 Workers shall not be required to operate equipment that has been deemed <br /> unsafe. <br /> ARTICLE 26 - TEMPORARY UPGRADING <br />The City agrees that any worker who is assigned by the Supervisor to work in a higher <br />paid classification shall receive the rate of pay at the bottom of the range of the higher <br />classification or an increase of five percent (5%), whichever is greater, for all hours <br />worked of four (4) hours or more in one (1) working day. A worker shall not be paid <br />temporary upgrade pay in increments of less than four (4) hours in one (1) working day. <br />In no event shall the worker so assigned receive more than the top of the range for the <br />higher classification. When a temporary upgrade lasts for thirty (30) consecutive <br />calendar days or longer, the worker's paid time off shall be compensated at the pay rate <br />of the higher classification. Police Records Clerks and Community Service Officers will <br />receive a temporary upgrade for any time they are required to work at dispatcher relief <br />duties. <br /> 44 <br />
