Fire Management shall be responsible to notify HR and <br /> Finance Departments regarding the refund. <br /> 9) The above provisions regarding captain compaction and paramedic pay <br /> supercede the provisions of the sideletter dated August 14, 1997. All other <br /> provisions of the August 14, 1997, sideletter stay in effect except if <br /> modified by mutual agreement. <br />7.8 Court Pay <br /> An off-duty employee who is subpoenaed to appear in court in cases in which <br /> the City is a party shall be compensated at one and one-half (1-1/2) times <br /> hislher regular straight-time rate for all hours the employee is so ordered to <br /> appear. Any fees received by the employee for their testimony will be turned <br /> into the City for deposit into the general fund. <br />7.9 Call-back Pay <br /> If a regular classified employee of the Fire Department, who has completed the <br /> normal shift or tour of duty, is called back to work, that employee shall, upon <br /> reporting for duty, receive a minimum ofthree (3) hours' work at the overtime <br /> rate. If three (3) hours' work is not required, the employee shall receive a <br /> minimum of three (3) hours' pay at the overtime rate. This provision does not <br /> apply to instances in which the employee is required to continue to remain on <br /> duty after completion of a normal shift or tour of duty. <br />7.10 Acting Pay <br /> 7.10.1 The City shall, whenever practical, assign those employees who have <br /> demonstrated their ability to perform the duties ofthe higher <br /> classification, and it is understood, that employees selected to <br /> perform the duties of a higher classification will be those who have <br /> achieved the top step of their regular classification. <br /> 7.10.2 Whenever a temporary vacancy occurs and it is determined by the <br /> City that the position should be temporarily filled, an employee may <br /> be assigned by the Fire Chief to work in the higher paid <br /> classification at a rate of pay which is ten percent (10%) above <br /> hislher adjusted hourly rate. <br /> 7.10.3 After a position has been temporarily vacant for fifteen (15) <br /> consecutive shifts, the City shall make a temporary appointment to <br /> fill such vacancy. Temporary appointment may continue for a period <br /> of one hundred eighty (180) days and may be extended by the <br /> Human Resources Director for an additional period of ninety (90) <br /> days. <br /> 13 <br />
