<br /> The benefits of sick leave and disability leave shall be mutually exclusive; and <br /> no disability leave may be used for the purposes specified under Section 18.1, <br /> Sick-Leave; and no sick leave benefits may be used for the purposes specified <br /> under Section 18.4, Disability-Leave. <br /> Employees in the above-mentioned classifications shall continue to accrue sick <br /> leave and vacation leave benefits and receive payment for holidays during the <br /> period of disability to a maximum of one (1) year or until retirement, whichever <br /> occurs first. <br />18.5 Military Leave <br /> Military leave shall be granted by the City in accordance with the provision of <br /> state and federal laws, and there may be a deduction for any military <br /> compensation that the employee receives for service during the period that <br /> he/she is receiving full pay from the City, if permitted by law. All employees <br /> taking military leave shall give the City an opportunity, within the limits of <br /> military regulations, to determine when such military leave shall be taken. <br />18.6 Leave of Absence Without Pay <br /> Any employee desiring a leave of absence without pay from his/her employment <br /> for any reason shall secure written permission from the Human Resources <br /> Director and the Fire Chief. The decision of the Human Resources Director or <br /> the Fire Chief on granting or refusing to grant a leave of absence or extension <br /> thereof shall be final and conclusive, and shall not be subject to the grievance <br /> procedure ofthis MOD. Except as otherwise provided in this Section, the <br /> maximum leave of absence shall be for one (1) year. <br /> During any approved leave of absence, the employee shall not engage in gainful <br /> employment unless authorized to do so by the written permission of the Human <br /> Resources Director and the Fire Chief. The Human Resources Director and the <br /> Fire Chief may terminate any employee who violates the terms and conditions of <br /> the written permission for leave or extension thereof. <br />18.7 Jury Duty <br /> Any employee whose name shall be selected from the list of trial jurors to serve <br /> as juror in a civil or criminal action pending in a Superior, Municipal, or Justice <br /> Court ofthe State of California, or any Federal Court convening in the State of <br /> California, or any employee required to report for the selection of a jury in any <br /> of these courts, shall receive pay for the time such service requires his/her <br /> absence from work; provided, however, that the City may require proof of the <br /> time such service was required and any monies received from jury duty served <br /> during scheduled work shifts shall be turned into the City; provided, further, that <br /> 35 <br />
