<br /> (c) After the satisfactory completion of the Project <br />in compliance with the Agreement, the Property shall be devoted <br />to affordable rental housing, consistent with the Redevelopment <br />Plan and shall not, in whole or in part, be devoted to any other <br />use or used for any other purposes except as may be approved by <br />the Agency in writing in advance. This covenant shall remain in <br />effect for the life of the Redevelopment Plan, as extended from <br />time to time. <br /> ( d) Section 504 of the Rehabilitation Act of 1973 <br /> (1 ) Pursuant to Section 514 (Public Law 93-112), the <br />Declarant agrees that no otherwise qualified persons with <br />disabilities shall, solely by reason of a disability, be <br />excluded from the participation in, be denied benefits of, or be <br />subjected to discrimination in the performance of the Agreement <br />or in the selection of low income owners to purchase the <br />dwelling to be built on the Property. <br /> (2 ) Compliance of Section 504 of the Rehabilitation <br />Act of 1973, as amended, requires that all benefits, aids and <br />services are made available to persons with disabilities on an <br />equivalent basis with those received by non-disabled persons. <br />The Declarant shall agree to be in compliance with Section 504 <br />requirements by developing a plan for compliance to be submitted <br />to the Section 504 Coordinator as soon as possible but not later <br />than by the close of escrow for the acquisition of the Property. <br />Certain units within the Project shall be constructed to comply <br />with Section 504 of the Rehabilitation Act of 1973 as set forth <br />in the Scope of Development. <br /> (e) Affirmative Action. The Declarant certifies that <br />it is in compliance with the Equal Employment Opportunity <br />Requirements of Executive Order No 11246, as amended by <br />Executive Order No 1375, Title VII of the Civil Rights Act of <br />1964, the California Fair Employment Practices Act and any other <br />federal or state laws pertaining to equal employment <br />opportunity, and that it will not discriminate against any <br />employee or applicant for employment or opportunity to purchase <br />the dwelling to be built on the Property on the basis of race, <br />religion, color, national origin, ancestry, sex, age, physical <br />or mental disability, marital status, sexual preference, or <br />political affiliation in matters pertaining to occupancy, <br />hiring, training, upgrading, transfers, compensation or <br />termination. <br /> 3 <br />
