<br /> (f) Fair Employment Practices <br /> (1 ) The Declarant agrees to not discriminate against <br />any employee or applicant for employment because of race, <br />religion, color, national origin, ancestry, sex, age, physical <br />or mental disability, marital status, sexual preference, or <br />political affiliation. The Declarant agrees to take affirmative <br />action to ensure that applicants are employed, and that <br />employees are treated during employment, without regard to their <br />race, religion, color, national origin, ancestry, sex, age, <br />physical or mental disability, marital status, sexual <br />preference, or political affiliation. Such action shall <br />include, but not be limited to the following: employment, <br />upgrading, demotion or transfers; recruitment or recruitment <br />advertising; layoff or termination; rates of payor other forms <br />of compensation; and selection for training, including <br />apprenticeship. The Declarant agrees to post in conspicuous <br />places, available to employees and applicants for employment, <br />notices to be provided by the City of Redwood City setting forth <br />the provisions of this Fair Employment Practices section. <br /> (2) The Declarant agrees to permit access to his <br />records of employment, employment advertisements, application <br />forms, and other pertinent data and records by the State Fair <br />Employment Practices Commission, or any other agency of the <br />State of California designated by the awarding authority, for <br />the purposes of investigation to ascertain compliance with the <br />Fair Employment Practices section of this contract. <br /> (g) Nondiscrimination Based on Disability. The <br />Declarant hereby agrees that it will, to the extent not <br />otherwise exempt, comply with the provisions of Section 504 of <br />the Rehabilitation Act of 1973, as amended, providing equal <br />access and reasonable accommodations in employment programs and <br />services to persons who are disabled. <br /> (h) All of the foregoing covenants shall run with the <br />land, and shall inure to the benefit of and be enforceable by <br />the City and the Agency, and its successors and assigns. <br /> (i) The covenants set forth in this Declaration shall <br />run in favor of the City and the Agency for the entire period <br />during which such covenants are to remain in force in accordance <br />with the foregoing, and shall be in effect without regard to <br />whether the City and the Agency has at any time been, remains, <br />or is an owner of any land or interest therein to which these <br /> 4 <br />
