(f) Fair Employment Practices (1 ) The Declarant agrees to not discriminate against any employee or applicant for employment because of race, religion, color, national origin, ancestry, sex, age, physical or mental disability, marital status, sexual preference, or political affiliation. The Declarant agrees to take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, religion, color, national origin, ancestry, sex, age, physical or mental disability, marital status, sexual preference, or political affiliation. Such action shall include, but not be limited to the following: employment, upgrading, demotion or transfers; recruitment or recruitment advertising; layoff or termination; rates of payor other forms of compensation; and selection for training, including apprenticeship. The Declarant agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided by the City of Redwood City setting forth the provisions of this Fair Employment Practices section. (2) The Declarant agrees to permit access to his records of employment, employment advertisements, application forms, and other pertinent data and records by the State Fair Employment Practices Commission, or any other agency of the State of California designated by the awarding authority, for the purposes of investigation to ascertain compliance with the Fair Employment Practices section of this contract. (g) Nondiscrimination Based on Disability. The Declarant hereby agrees that it will, to the extent not otherwise exempt, comply with the provisions of Section 504 of the Rehabilitation Act of 1973, as amended, providing equal access and reasonable accommodations in employment programs and services to persons who are disabled. (h) All of the foregoing covenants shall run with the land, and shall inure to the benefit of and be enforceable by the City and the Agency, and its successors and assigns. (i) The covenants set forth in this Declaration shall run in favor of the City and the Agency for the entire period during which such covenants are to remain in force in accordance with the foregoing, and shall be in effect without regard to whether the City and the Agency has at any time been, remains, or is an owner of any land or interest therein to which these 4
