<br /> (a) Declarant and its successors shall ensure that <br /> each lessee of the Property executes under penalty of perjury an <br /> income verification and information form ( "Income Verification <br /> and Information Form") , in a form reasonably acceptable to the <br /> City and/or Agency, certifying the lessee's income. Units will <br /> be leased only to lessees who have incomes qualifying under the <br /> affordability covenants set forth herein. <br /> (b) Declarant and his successors shall obtain a copy <br /> of each lessee's federal income tax return for the taxable year <br /> immediately preceding such lessee's initial occupancy in the <br /> Project or, if a lessee certifies that he or she did not file or <br /> did not retain a copy of such tax return, other satisfactory <br /> evidence of income for such year, such, as wage statements or <br /> employer records. <br /> (c) Annually, the Declarant and its successors shall <br /> provide to the City and/or Agency copies of said executed Income <br /> Verification and Information Forms with respect to each lessee <br /> along with a summary for the applicable year signed by the <br /> Declarant or its successor certifying compliance with the <br /> provisions of this Declaration under penalty of perjury. <br /> (d) To certify the compliance of the Declarant or its <br /> successor with these provisions, the Agency shall have a right <br /> to inspect the books and records pertaining to such matters of <br /> the then owner(s) or operator(s) of the Property. <br /> (e) Pursuant to 24 CFR 92.303. The Participating <br /> Owner must adhere to a "Fair Lease and Grievance Procedure" <br /> approved by the City and must follow the Tenant Participation <br /> Plan submitted to the City in accordance with the OPA. <br /> (f) Reporting Requirements <br /> The Participating Owner shall submit the following reports <br /> as follows: <br /> 1) Direct Benefit Report. When the Project is <br /> completed, as evidenced by the issuance of the <br /> Certificate of Completion, and is available for rent <br /> by qualified tenants, the Participating Owner shall <br /> submit a Direct Benefit Report, in substantially the <br /> same form as attached to this Scope of Development as <br /> Attachment No. I, annually on July 15 for the duration <br /> of the Declaration of Affordability Covenants¡ and <br /> 6 <br />
