Finally,the highly confined building <br /> and site would deprive school children of play area, safe outside emergency gathering <br /> area, and for the most part even windows to look out of. Aside from local and state <br /> standards, this condition in my opinion is an unacceptable environment for children to be <br /> subjected to. The result would be a substandard school facility in many respects. <br /> In my opinion, this elementary school would be unsafe and inappropriate for the <br /> proposed site and building. The site is far too small to accommodate a standard school <br /> facility and the industrial neighborhood is far too dangerous for children. An elementary <br /> school would be incompatible with the surrounding industrial uses and vice-versa. The <br /> primary purpose of zoning is to prevent this kind of incompatible use condition from <br /> happening. The school would also result in numerous significant environmental impacts <br /> (some of which are identified above)for which no mitigation is reasonably obtainable. I <br /> do not feel the applicable CEQA, land use permit,variance or rezoning findings can be <br /> met for this proposed Project. As a result, I feel the City and County would be strapped <br /> with long-term safety,public animosity and legal issues if the Project were to be <br /> approved and developed. It is therefore my opinion that the Project should be denied. <br /> Should the City choose to continue review of the proposed Project, I feel that an <br /> Environmental Impact Report would be imperative to address the many very real impacts <br /> posed by the Project, and that mitigations be prepared for as many of the significant <br /> impacts as possible. Public health and safety impacts would be of primary concern. The <br /> proposed Mitigated Negative Declaration is a wholly insufficient document to address the <br /> numerous potentially significant impacts posed by the project. Regional, state and <br /> federal agencies would also need to become an integral part of the review process. In <br /> addition,it is quite clear by the current analysis that numerous significant impacts would <br /> not be able to be mitigated,therefore,a Statement of Overriding Circumstances would be <br /> necessary to address health and safety impacts that cannot be mitigated to a point of <br /> insignificance. <br /> Sincerely, ip <br /> Way?e P.
