shall be applied separately to each Beneficiary <br /> with respect to that Beneficiary' s share in the <br /> Participant ' s Account . <br /> (f) No Beneficiary shall have any right of recovery <br /> against the Employer or the Plan for any <br /> distributions that are made in the name of the <br /> Participant before a Plan representative has been <br /> duly notified of the Participant ' s death. <br /> 6 . 8 Limitations on Distribution Options : No distribu- <br /> tion option may be selected by a Participant or Beneficiary under <br /> this Article 6 unless it satisfies the requirements of sections <br /> 401 (a) (9) and 457 (d) (2) of the Code, including that installment <br /> payments be made in substantially nonincreasing amounts and that <br /> payments commencing before the death of the Participant satisfy <br /> the incidental death benefits requirement of section <br /> 457 (d) (2) (3) (i) (I) . The terms of this Article shall be construed <br /> in accordance with those Code sections and the regulations <br /> thereunder. Unless otherwise elected by the Participant or a <br /> Beneficiary, all distribution periods based on life expectancies <br /> shall be determined in the manner required under section <br /> 401 (a) (9) of the Code without recalculation of life expectancies. <br /> 6 . 9 Distributions from Fund: Except as otherwise <br /> provided herein, all distributions shall be made directly from <br /> the Fund to the Participant or Beneficiary.
