m <br /> and services account maintained pursuant to section 21678 of the <br /> Government Code . <br /> 1 . 12 Government Code : Those statutes of the State of <br /> California that have been codified as the Government Code . <br /> 1 . 13 Includible Compensation. A Participant ' s calendar <br /> year compensation from the Employer that is includible in gross <br /> income for Federal income tax purposes . Such term does not <br /> include any Deferral excludable from gross income under this Plan <br /> , or any other amount excludable from gross income under section <br /> 457 (a) , 403 (b) , 401 (k) , or 125 of the Code . Includible <br /> Compensation shall be determined without regard to any community <br /> property laws. <br /> 1 . 14 Investment Option: One of the available alterna- <br /> tives for crediting investment earnings to a Participant ' s Account, <br /> which shall be based upon the performance of one or a combination <br /> of the investment portfolios maintained under the Fund. <br /> 1 .15 Normal Retirement Age ; The age used to determine <br /> the three-year period in which a Participant may utilize the <br /> catch-up limitation under Section 4 . 2 . A Participant may <br /> designate as his or her Normal Retirement Age the age that will <br /> be attained in any Year that is not earlier than the earliest <br /> Year in which the Participant will be eligible to retire without <br /> actuarial or similar reduction under PERS or another retirement <br /> system and that is not later than the Year of the Participant ' s <br /> Required Beginning Date . Once a Participant has utilized the <br /> catch-up limitation under Section 4 . 2 or under a comparable <br /> 4 <br /> provision of another Eligible Deferred Compensation Plan, that <br /> Participant ' s Normal Retirement Age may not thereafter be changed. <br />
