1 . 16 Participant : Any Employee or former Employee for <br /> whom a Deferral has been credited under the Plan and for whom an <br /> Account is maintained. <br /> 1 . 17 PERS : The Public Employees ' Retirement system of <br /> the State of California. <br /> 1 . 18 Plan: The California Public Employees ' Deferred <br /> Compensation Plan established pursuant to sections 21670 through <br /> 21678 of the Government Code, the terms of which are set forth in <br /> this Plan document. To the extent required under section 457 of <br /> the Code, each Employer' s participation in this Plan shall be <br /> treated as a separate plan, and each Employer' s separate plan <br /> shall be deemed to include any other Eligible Deferred Compen- <br /> sation Plan maintained by that Employer. <br /> 1 . 19 Required Beginning Date : April 1st of the Year <br /> following the Year of a Participant ' s attainment of age 70% or <br /> Separation from Service, whichever is later. <br /> 1 . 20 Separation from Service : The cessation of an <br /> Employee ' s active employment with an Employer. The standards <br /> applicable under section 402 (d) (4) (A) (iii) of the Code shall <br /> apply in determining whether a Participant has had a Separation <br /> from Service with the Employer. An Employee ' s rights upon <br /> Separation from Service with an Employer shall be unaffected by <br /> whether the Employee thereafter becomes an Employee of another <br /> Employer that has adopted this Plan. <br /> 1 . 21 Transfer: An amount credited to a Participant ' s <br /> Account by reason of a transfer from another Eligible Deferred <br /> Compensation Plan. <br />
