case of necessity of actual sickness or disability. Charge for sick leave <br />used shall be on the basis of one (1) hour for each hour used; provided <br />however, that sick leave shall be charged for only those hours when the <br />employee was absent from work. Sick leave may not be used before it is <br />earned. <br />9.1.2 Employees, upon completion of their initial six (6) months of <br />employment, shall be eligible for sick leave benefits, to a maximum of the <br />hours accrued, for absence due to non -occupational disability only during <br />the time such disability, illness, or other sickness or injury continues. <br />At the City's request, an employee who has been absent more than three <br />(3) days must file with the City a statement by a person licensed to <br />practice medicine or dentistry that the employee was under said doctor's <br />care while absent. When an employee returns to work after any absence <br />chargeable to sick leave or as a result of an industrial absence or illness, <br />the City may require a statement from a physician that the employee is in <br />fit physical condition to perform all the duties of his or her position. In <br />addition, the employee may be required to undergo a medical examination <br />at the City's expense to be performed by a doctor designated by the City, <br />before the employee is permitted to return to work. <br />An employee may use up to five (5) days of accrued sick leave in any <br />calendar year for illness in the immediate family. For the purpose of this <br />Section, immediate family means spouse or child. <br />9.1.3 Except in cases of extreme emergency or exceptional unforeseen <br />circumstances, in order to receive compensation for absences charged to <br />sick leave, the employee shall notify his/her immediate supervisor no less <br />than one-half hour plus travel time prior to the scheduled time for <br />beginning his/her work duties of the impending absence. At the same <br />time, the employee shall provide the immediate supervisor with a <br />telephone number where he/she can be reached during the term of the <br />absence. The burden of proof of extreme emergency or exceptional <br />unforeseen circumstances shall be upon the unit member. <br />9.1.4 Sick leave with pay shall not be granted or accrued when the disability <br />arises from any illness, sickness or injury purposely self-inflicted or <br />caused by any willful misconduct or when disability is sustained while <br />engaged in a gainful occupation (other than City service) either as an <br />employee, officer, executive or as a business or professional proprietor or <br />partner. <br />9.1.5 In the event an employee has accumulated the maximum sick leave credits <br />of nine hundred sixty (960) hours and the employee becomes so severely <br />ill that he or she exhausts his or her sick leave, the Personnel Officer may, <br />upon written recommendation of the employee's department head, <br />authorize additional sick leave to include any sick leave in excess of the <br />15 <br />
