Item No. 1 (continued ) <br />In response to question, City Attorney Schri cker said that adoption of <br />smoking regulations is a policy matter; that with regard to Section <br />15.4(b)( 4) the meani ng of "dispute" would be establ ished by employer <br />practices in the workplace; that with regard to individual rights, there is <br />more than adequate justification for the ordinance on medical and public <br />health grounds; that with regard to enforcement, violations would be <br />infractions with no jury trial but only summary proceedings with different <br />limits of fines imposed; and that with regard to a bar and dining room, the <br />designation of smoking area could be contiguous to the bar. <br />M /S: Murray /Stangel to amend Secti on 15.5(a)( 5) to i nsert "or bi ngo games" <br />after "functions". <br />CHANGE OF MOTION: to change the proposed amendnent to insert after <br />"function", the following: "or for bingo games conducted pursuant to permits <br />issued under Chapter 8.a. of the Redwood City Municipal Code shall be <br />excluded from the prohibition of smoking". <br />The motion <br />as changed <br />failed <br />on the following roll call vote: <br />Ayes: <br />Councilmen <br />Murray <br />and Stangel <br />Noes: <br />Councilmen <br />Buchan, <br />Bury, Claire, LaBerge and Mayor Greenalch <br />MOTION: LaBerge /Claire in Section 15.5(a)(5) after "function", the following <br />"or for public events staged by nonprofit organizations with the condition <br />that the organization must publicize the event as one where smoking is <br />perm i tt ed " . <br />The motion carried unanimously by roll call vote. <br />Mayor Greenalch asked Mr. Schricker to refine the drafting of the ordinance <br />as may be necessary in order not to create any "loopholes" with regard to the <br />intent of the ordinance. <br />MOTION: Stangel /LaBerge in Section 15.4(c) change "three weeks" to 11 60 days' <br />in accordance with the written request of Ampex in their letter of June 3, <br />1988. <br />Carried unanimously by voice vote. <br />MOTION: Murray /Stangel in Section 15.4(b) change "60 days" to "90 days ". <br />Carried unanimously by voice vote. <br />Title read.
