Item No. 1 (continued ) In response to question, City Attorney Schri cker said that adoption of smoking regulations is a policy matter; that with regard to Section 15.4(b)( 4) the meani ng of "dispute" would be establ ished by employer practices in the workplace; that with regard to individual rights, there is more than adequate justification for the ordinance on medical and public health grounds; that with regard to enforcement, violations would be infractions with no jury trial but only summary proceedings with different limits of fines imposed; and that with regard to a bar and dining room, the designation of smoking area could be contiguous to the bar. M /S: Murray /Stangel to amend Secti on 15.5(a)( 5) to i nsert "or bi ngo games" after "functions". CHANGE OF MOTION: to change the proposed amendnent to insert after "function", the following: "or for bingo games conducted pursuant to permits issued under Chapter 8.a. of the Redwood City Municipal Code shall be excluded from the prohibition of smoking". The motion as changed failed on the following roll call vote: Ayes: Councilmen Murray and Stangel Noes: Councilmen Buchan, Bury, Claire, LaBerge and Mayor Greenalch MOTION: LaBerge /Claire in Section 15.5(a)(5) after "function", the following "or for public events staged by nonprofit organizations with the condition that the organization must publicize the event as one where smoking is perm i tt ed " . The motion carried unanimously by roll call vote. Mayor Greenalch asked Mr. Schricker to refine the drafting of the ordinance as may be necessary in order not to create any "loopholes" with regard to the intent of the ordinance. MOTION: Stangel /LaBerge in Section 15.4(c) change "three weeks" to 11 60 days' in accordance with the written request of Ampex in their letter of June 3, 1988. Carried unanimously by voice vote.
