6.1.C. - Page 3 <br />The right is reserved, as the interest of the City may require, to purchase <br />individual equipment, materials, vehicles or supplies from more than one <br />Bidder or all equipment, materials, vehicles or supplies from one Bidder, to <br />reject any or all bids, to waive any informality in bids, and to accept, <br />modify, or reject any items of the bid. <br />Section 2.68(C) of the Purchasing Ordinance states: <br />The Council may waive any irregularities in bids received or permit the <br />correction of erroneous bids when the Council finds that the irregularity or <br />error was not the result of fraudulent intent on the part of the bidder and <br />that the best interests of the public would be served thereby. <br />ALTERNATIVES <br />The eight vehicles scheduled for replacement have already exceeded their useful life <br />and it would not be economically viable to invest in the continued use and repair of <br />these vehicles if they were to experience a major breakdown due to their age and <br />condition. Not approving the purchase of the vehicles would negatively impact the <br />operations of the Police Department since the vehicles are intended to be used on a <br />daily basis. <br />FISCAL IMPACT <br />Funds in the amount of $291,955.04 are available in the FY 2017-18 Equipment <br />Replacement Fund Budget. This amount will be subsequently recovered from the <br />operating budget of the user department through vehicle replacement charges in future <br />years. <br />ENVIRONMENTAL REVIEW <br />This action is not a "project" within the meaning of the California Environmental Quality <br />Act (CEQA) because the purchase of eight Ford Police Interceptors will not cause a <br />direct physical change in the environment or reasonably foreseeable indirect physical <br />change in the environment.
