6.1.A. - Page 3 <br />and environmental permitting for the Project. The County took the lead the preliminary <br />MOU effort. On May 16, 2017, the County Board adopted a Resolution, authorizing <br />County's on-call consultants to be retained to provide engineering and professional <br />services for the Flood Resilience Program under the direction of the Director of Public <br />Works when and if services are needed. <br />The purpose of the MOU is to establish the terms and conditions for the cost sharing <br />and responsibilities of the Bayfront Canal/Atherton Channel Collaborative <br />(Collaborative), which consists of the City of Redwood City, the City of Menlo Park, the <br />Town of Atherton (Cities) and the County of San Mateo (County). The Town of <br />Woodside was invited to participate; however, on July 26, 2017 the Town of Woodside <br />notified the County that the Town of Woodside would not be participating in the MOU. <br />On September 6, 2017, the City of Redwood City's Bayfront Canal City Council <br />Subcommittee (Bain, Borgens, Gee) was convened to review the terms of the MOU. <br />The Subcommittee expressed overall support for the project, however had concerns <br />about project timing. Specifically, the Committee wanted to make certain that the <br />collaboration would not delay the Project's December 2018 completion date. The <br />Committee also had a specific concern that the MOU could be terminated, and work <br />would stop, with a 30 -day notice from any agency. Those concerns were expressed to <br />the other member agencies, as described in the report below. <br />The MOU was originally expected to be approved by the Town of Atherton and City of <br />Menlo Park earlier this month. However, the Town of Atherton Council continued the <br />item, noting several concerns and requests for additional information. The City of Menlo <br />Park did not hear the item in September, and the item is now scheduled for October. <br />The following is now the anticipated schedule for consideration of the MOU by each <br />agency: <br />• Town of Atherton - October 4th <br />• City of Menlo Park - October 10th <br />• San Mateo County - October 17th <br />Due to the concerns expressed by the Town of Atherton, City staff will be concurrently <br />working on an alternative plan to complete design and construction of these flood <br />improvements in a timely manner. While this collaboration and MOU would result in <br />each jurisdiction taking responsibility for their stormwater, ultimately, time is the most <br />important factor, as residents are severely impacted each time this area floods. <br />ANALYSIS <br />The Memorandum of Understanding (MOU) covers consulting costs for the planning, <br />engineering, environmental permitting and negotiation of property access rights on the <br />Bayfront Canal and Atherton Channel Flood Improvement Project among the agencies <br />that share the watershed. The consultants will work under contract with the County of <br />San Mateo (County), who will be the contracting agency and serve as the Project <br />
