<br /> "Alternate Rent" shall mean, for any period, the lesser of (i) the Base Rent otherwise <br /> I?ayable during the applicable period, or (ii) the product of (x) the Percentage Rent Rate specified <br /> in Section 1.1 multiplied by (y) the amount of Tenant's Gross Sales during the applicable period. <br /> "Anniversary" shall mean twelve (12) full calendar months from the date of a given <br /> event. Any reference to an Anniversary of the Commencement Date shall mean twelve (12) <br /> month periods beginning on the Commencement Date~ unless the Commencement Date occurs <br /> on a day other than the first day of a calendar month, in which case, Anniversary shall mean each <br /> period of twelve (12) full calendar months beginning on the first day of the calendar month <br /> immediately following the Commencement Date. <br /> "Applicable Laws" shall mean any law, ordinance, order, rule, regulation, requirement <br /> or judicial decision of any Governmental Authority which is at an y time during the Term <br />" applicable to the Premises or the Center, including, Environmental Laws. Such laws, ordinance, <br /> orders, rules, regulations shall include, without limitation, any of those which relate to zoning, <br /> public health,' public safety, environmental protection, accessibility, the removal of architectural" <br /> barriers and the existence or removal of any Hazardous Materials. <br /> "As-Built Plan" shall have the meaning given such term in Section 2.2. <br /> "Block One" and "Block Two" shall mean the respective areas that are so designated on <br /> Exhibit A-I attached hereto. <br /> "Building" shall mean the two-story building constructed or to be constructed by <br /> Landlord on Block One, substantially as depicted on the Site Plan attached hereto as Exhibit A-I, <br /> which shall contain approximately 78,215 square feet of Net Leasable Floor Area of retail <br /> premises (in addition to the Premises) and the second floor of which will contain the Premises, <br /> for a total of approximately 151,400 square feet of Net Leasable Floor Area. <br /> "Center" shall mean the development, project or real property commonly known as the <br /> "On Broadway" located in the City of Redwood City, San Mateo County and State of Cali fomi a, <br /> which is outlined on the Site Plan attached hereto as Exhibit A-I and which shall be constructed <br /> by Landlord in accordance with the Redevelopment Agreement and this Lease. The Center shall <br /> contain (in addition to the Premises), without limitation, (i) approximately 78,215 square feet of <br /> Net Leasable Floor Area of ground floor retail space, and (ii) the Common Areas.
