<br />Liability and Insurance <br />1. We provide lighting design services only, and we will be responsible only for the lighting effects and <br /> specification of suitable products to achieve those effects. We will have no responsibility for wiring <br /> methods, power distribution design, building waterproofing, seismic-resistant supports, hazardous <br /> material detection or removal, sequences or methods of construction, nor for changes in design or <br /> products made without our approval. <br />2. We maintain a $1,000,000.00 commercial general liability insurance policy. <br />3. We maintain a $1,000,000.00 professional liability insurance policy with a $10,000.00 deductible. <br />Photography and Publication <br />1. If you or we hire a photographer to photograph the project, we agree to notify each other before the <br /> shoot begins so we can discuss sharing the cost of photography and access to the finished images. <br />2. If you submit the finished project for publication, you agree to submit our name as one of the design <br /> consultants as follows: <br /> Lighting: David Malman, Architectural Lighting Design <br />Termination <br />I. This contract may be tenninated by either party upon receipt of written notice. <br />2. You agree to compensate us as described below for the percentage of work perfonned and for <br /> expenses incurred before the written notice is received. <br />3. If you tenninate us, you will indemnify us against any claims regarding our work. <br />4. If substantial architectural work on the project is stopped for more than three months and later <br /> resumed, we will be entitled to an additional Project Restart Fee of 10% of the total Basic Services <br /> Fee quoted below. <br /> 4 <br />
