Item No. 2 (continued) <br />Mayor Greenalch declared the public hearing open at 8:40 p.m. and invited <br />anyone present who wished to speak to do so. No one wished to speak. <br />M /S: Murray /Bury to close the public hearing. <br />Carried unanimously by voice vote and public hearing closed at 8:41 p.m. <br />M /S: Murray /Bury to uphold the decision of the Planning Commission in <br />approving subject application, with the following findings adopted: <br />(a) The property is of such shape, or size, or is affected by such <br />topographical conditions, or is subject to such title limitations <br />of record that it is impossible or impractical for the subdivider <br />to comply with the requirements with which exception is taken. <br />(b) The exception is necessary for the preservation and enjoyment of <br />a substantial property right of the subdivider. <br />(c) The granting of the exception will not be detrimental to the <br />public welfare or injurious to other property in the vicinity of <br />the subject property. <br />Carried unanimously by voice vote.
