q <br />[1. <br />hereby formally protest against the work or improvement described in Resolution of <br />Intention No.H-¢, passed and adopted by the Board of Trustees of the Town of Redwood City <br />on the 6th day of April,1925, and against the extent. of the district to be assessed for said <br />I <br />proposed work, and as grounds of such protest specify: <br />I. <br />That there is no present urgent necessity for said work in the manner proposed, <br />and that the present condition of the street..or streets therein involved is sufficient for <br />a <br />the accommodation of all travel thereon. <br />II. <br />That the proposed improvement will not benefit the property of the under - <br />signed in any wise or at. all, or to any extent commensurate with the proposed cost thereof. <br />III. <br />That the proposed assessment district discriminates against .the property of <br />t7ge undersigned by including the same within said assessment district while excluding other <br />properties similaryly situated. <br />That the proposed work or improvement is of an excessively expensive type and <br />estimated to cost about thirty (30) cents a square foot by the use of Vibrolithic concrete, <br />whereas an equally good, if not better, pavement could be provided by the use of plain <br />concrete. which would cost including grading, not more than twenty-six (26) cents a square <br />foot, and such concrete pavement would be more durable and have a longer life. <br />V. <br />That the propertties ofthe undersigned are in said assessment district; but <br />said properties will not be benefited by said work and should be excluded from said district. <br />Vi. <br />That by reason of errors in said proceedings, the Board of Trustees of the <br />Town of Redwood City has not acquired jurisdiction to charge the expenses of said improve- <br />ment, or any thereof, to the property of the undersigned, or to any of the properties of <br />the undersigned, and charge or lien against said properties of the undersigned. will be <br />unenforcable and invalid. <br />WHEREFORE, the undersigned pray that said proceedings be abandoned; that <br />that the properties of the undersigned be excluded from said assessment district,atat.that <br />in any event a less expensive type of improvement should be decided upon in that event that <br />a <br />your Honorable Board should determine to proceed with said improvement. <br />SOUTHERN PACIFIC RAILROAD 0011'ANY. <br />By Be Be Leavitt <br />--------------------------------- <br />Lease Agent. <br />SOUTHERN PACIFIC COMPANY, <br />By Be Be Leavitt <br />--------------------------- <br />Lease Agent. <br />r <br />Lloved by Trustee Ivionteith,seconded by Trustee Mabie,the protest of the Southern Pacifies <br />Railroad Company,and Southern Pacific Company, be overruled.
