243 <br />RESOLVED by the Council of the,City of Redwood City that the <br />City Manager of said City take the necessary. steps to exercise. the <br />options to purchase those certain portions of Lot 3, 4 and 5 described <br />on that certain map entitled °Map of Certain Harbor Lands Belonging to <br />the Redwood -City Harbor Comp 11 filed for record September 23, 19210 <br />in Volume 10 of Maps at pages 5 and 46 in the Recorder's office of <br />the County of San. Mateo, State of California, and,.further described in <br />those certain option agreements dated Febuary 29, 1936, and made between <br />George A. Merrill and Sarah S.- Merrill, his wife, first parties, and the <br />City of Redwood City, second -party, and recorded November -25, 1936, in <br />Volume 713 of Official Records at page 427, San Mateo -County Records, <br />and also that certain option agreement dated the 26th day of February, <br />1936, and made between JosephrAtwood., Executor of the 1ast,Will and, <br />Testament of Andrew A: Brown,deceased, and Peter Tum Suden, Executor <br />of the last Will and Testament of Ada I. Brown, deceased, the parties <br />of the first part, and.the City of Redwood.City, party of the second <br />part, and recorded on November 25, 1936, in Volume 713 of Official <br />Records at page 429, San Mateo County Records, and also.that certain <br />option agreement made -and entered into the 29th day,of February, 1936, <br />between Lilian A. Rolph, first party, and the City of Redwood City, <br />second party, and.recorded November 25, 1936, in Volume 713 of Official <br />Records: at,page 427, San Mateo County. Records, when the City has the <br />money available for the payment of'. the purchase price of said lands and <br />the exercising of said options. <br />Councilman Eva, seconded by Councilman Christensen, proposed the adoption of several resolu- <br />tions, per sample below, pertaining to foreclosure proceedings in connection with <br />delinquent 1915 Act Bond Assessments. Unanimously carried. <br />RESOLUTION ORDERING FORECLOSURE OF STREET IMPROVEMENT <br />ASSESSMENT NO. 91B <br />UNDER RESOLUTION OF INTENTION NO. J-10 <br />RESOLVED'by the Council of the City of Redwood.City that the <br />City Attorney be and he is hereby ordered and directed ,to.commence and. <br />prosecute to conclusion an action in the Superior Court of the State of <br />California, in and for the County of San Mateo, to foreclose the delin- <br />quent street assessments under the "Improvement Bond Act of 19151, of <br />the State of California, upon the following described real property <br />situated in said City of Redwood City, to -wit: <br />Northwesterly portion of Lot 16, Block 7., New High- School Acres:, <br />fronting 40, feet on St. Francis Avenue•, as shown on that certain <br />map entitled•"New High School Acres" Redwood City, California, <br />filed in the office of the County Recorder of San Mateo County, <br />June 25, 1923, in Volume it of Maps at pages 36, 37 and 3g. <br />The City Attorney explained that he had had a conversation with the Attorney representing <br />Mrs. Dayse D. London in connection with her claim against the City for injuries sustained <br />when she fell on the sidewalk on Broadway near Birch Street, and that he had recommended <br />that the claim of $1,500 be compromised for the sum of $500. On motion of Councilman <br />Jones, seconded by Councilman McNulty, the City Attorney was suthor12ed to make the <br />compromise as suggested. <br />Councilman Eva, seconded by Councilman Jones, proposed that the City Attorney prepare an amend - <br />went to existing ordinances covering the location of nursery schools, convalescent homes <br />and similar institutions in the first and second residential sections of the City and <br />that such suggested amendment be prepared for submission to the Planning Commission. <br />Carried. <br />Councilman Eva reported that he had been approached by property owners along E1 Camino Real <br />who complained that because of the excessive restrictions, it was unprofitable for them <br />to consider making any improvements, and in line with this discussion, Councilman Eva <br />proposed, seconded by Councilman McNulty, that the Clerk be asked to take up with the <br />
