<br />IfAND {WHEREAS, in and by said Resolution of Intention No. 1938-5 said
<br />Council fixed Monday, the 29th day of August, 1938, at the hour of 8:00
<br />.o►clock P. M. of said day, at the meeting place of said Council in the
<br />Firehouse on Middlefield Road in said City of Redwood City, County of San
<br />14fateo, State of California, as the day, hour and place when and where any
<br />and all persons having any objections to the proposed work and improve-
<br />ments described in said Resolution of Intention No. 1938-5, or to the
<br />grades at which said work and improvements are to be done and made, or to
<br />the district to be assessed for said work and improvements, could appear
<br />before said Council and show cause why said work and improvements should
<br />not be carried out and done in accordance with said Resolution of Intention
<br />No. 1938-5, or why said work and improvements should not be carried out and
<br />done at the proposed grades as shown on the plans, profiles, detailed draw-
<br />ings and specifications referred to in said Resolution of Intention No.
<br />1938-5 and now on file in the office of the Clerk of said City; and
<br />WHEREAS, at the day, hour and place above mentioned, when and where
<br />objections could be made as aforesaid, certain owners of property in the
<br />district to be assessed for said work and improvements made written ob-
<br />jections to said work and improvements; and
<br />WHEREAS, said Council did proceed to hear and consider said protests
<br />and objections, and said Council having fully considered the same:
<br />THEREFORE BE IT RESOLVED by the Council of the City of Redwood City,
<br />and said Council does hereby determine and declare that said protests and
<br />objections were not and are not made by the owners of one-half of the area
<br />of the property in the district to be assessed for said work and improve-
<br />ments.
<br />AND BE IT FURTHER RESOLVED by said Council that said written protests
<br />and objections, and each and all thereof, be and the same are hereby over-
<br />ruled."
<br />Following this, Councilman Fletcher, seconded by Councilman Hohn, proposed the
<br />adoption of the following resolution: Carried.
<br />"RESOLUTION ORDERING THE {PORK NO. 1938-5
<br />°RESOLVED, THAT WHEREAS, the Council of the City of Redwood City did,
<br />on the 8th day of August, 1938, pass and adopt Resolution of Intention 1938-5
<br />to order the hereinafter described work to be done and improvements to be made
<br />in said City of Redwood City; and
<br />IWFREAS, notices of the passage of said Resolution of Intention No. 1938-5,
<br />headed °NOTICE OF IMPROVEMENT".. were duly and regularly posted along the line
<br />of said contemplated work and improvements and in front of all the property
<br />liable to be assessed therefor, and on all of the streets in the district to
<br />be assessed therefor, in time, form, manner and number as required by law, as
<br />appears from the affidavits of C. L. Dimmitt, Superintendent of Streets of the
<br />City of Redwood City, and Lisle Tlinter, and now on file in the office of the
<br />Clerk of said City; and
<br />WHEREAS, it appears from the affidavits of said C. L. Dimmitt and Lisle
<br />Winter, hereinbefore referred to herein, that the posting of said notices of
<br />improvement as aforesaid was completed on the 15th day of August, 1938; and
<br />MHEREAS, it appears from the affidavit of Bernice Gardner that said
<br />Resolution of Intention No. 1938-5 was fuly and regularly published in the
<br />Redwood City Tribune, a daily (except Sunday) newspaper published, printed
<br />and circulated in said City of Redwood City;.and
<br />WHEREAS, in and by said Resolution of Intention No. 1938-5 and the
<br />notices of the passage thereof posted as aforesaid, said Council of the City
<br />of Redwood City fixed Monday, the 29th day of August, 1938, at the hour of
<br />8:00 o'clock P. M. of said day at the Council Chamber of the Council of the
<br />City of Redwood City in the Firehouse on Middlefield Road in said City, as
<br />the day, hour and place when and where any and all persons having any ob-
<br />jections to the proposed work and improvements described in said Resolution
<br />of Intention No. 1938-5, or to the grades at which said work and improvements
<br />are to be done and made, or to the district to be assessed for said work and
