The bid complied with all advertising requirements. <br />Councilman Fletcher offered resolution, seconded by Councilman Armstrong, <br />accepting bid from 128th Naval Constructa.on Battalion, Camp Parks, California, <br />for leasing of band instruments. Carried on call of roll.. <br />Rezoning of Lot 7, Vera Avenue Villa was next brought up,for discussion. .Mr. 0. F. <br />Nuckolls, attorney for the protestants, addressed the Council saying that he <br />had asked for the matter to be continued to this meeting in order, for City <br />Attorney McCarthy, to draw up an ordinance making some changes in the zoning <br />laws. He had volunteered to work with Mr. McCarthy. An ordinance had been <br />prepared and was ready to be submitted to the Planning Commission for its. <br />approval. The Planning Commission meets on December 14th, and Mr. Nuckolls <br />asked that the matter be continued until the next regular meeting of the <br />Council. <br />Mr. Martin Flynn, representing his mother, Mrs. Helena Flynn,, stated that the <br />Planning Commission had unanimously agreed to take the property out of the <br />fire zone and requested,the Council to pass favorably on the recommendation <br />of the Planning Commission. <br />City Clerk R. S. Dodge read a letter from the Planning Commission approving by <br />resolution the rezoning of Lot 7, Block A. Vera Avenue Villas and recommending <br />that such change be made by ordinance. <br />Councilman Armstrong waked what the net effect was of the application filed <br />with the Council. City Attorney McCarthy replied that an ordinance might be <br />proposed ordaining change from fire zone district to second residential <br />district. Councilman Armstrong aksed if action taken at this meeting would <br />be final. City Attorney McCarthy explained that the fire zone was changed <br />when E1 Camino Real was widened and placed it, to include the lot in question <br />1>3 feet from the highway. He further explained that the intent of the fire <br />zone is that property fronting on El Canino Real is to be kept for fireproof <br />buildings. Councilman Armstrong asked if multiple dwellings would be per <br />mitted if property were put into second residential zone. City Attorney <br />McCarthy stated that if City Council changes fire zone, multiple dwellings <br />could be erected. Mr. Flynn explained the reason for wanting property taken <br />out of fire zone is that property is for sale and cannot be sold while in <br />fire zone as the value of property for business did not justify expenditure <br />of the cost of a fire proof structure. <br />Mrs. Skivo spoke from the floor protesting changing property from fire zone to <br />second residential zone. <br />Attorney Nuckolls brought out the fact that if ordinance is passed changing <br />property to second residential zone it will take in exact property on which <br />multiple dwelling was p3poposed to be built a short time ago, and asked again <br />to have matter continued to next meeting. <br />Oauncilman Britschgi offered introduction of ordinance, seconded by Councilman <br />Fletcher approving rezoning.
