Councilman Armstrong asked what the cost would be to the City in the <br />event the motion carried and the City was sued over failure to issue a building <br />permit. City Attorney McCarthy advised Councilman Armstrong that it would cost <br />the City only the services rendered by him in defending the suit. Motion before <br />the Council passed unanimously.HE <br />_ <br />Mayor Granger asked City Attorney McCarthy the status of the Olive Koemple suit t.US <br />'against the City. City Attorney McCarthy replied that he had conferred with <br />Mr. Penaat, the attorney for Mrs. Koemple, who stated that he was seeking to <br />strike out a portion of the pleapof the plaintiff and that they had agreed"to . <br />ask for the case to be set sometime in. February. <br />Mr. Carbine appeared before the Council in regard to the schedule and fares charged <br />by the Redwood City Bus Line•and asked if these matters 'came under the jurisdic- <br />tion of the Council. He stated that persons who used the "B" bus after 4 o'clock <br />were forced to take two buses to reach the business district and were charged <br />two fares. City Attorney McCarthy stated that neither the City Council nor the <br />City had any control over the fares chargecT or the schedules of the bus line, <br />however, the Council could delegate City Manager Mead to confer with Mr. Martin, <br />the proprietor of the bus. line and then if no agreeable settlement of the matter <br />I <br />ould be reached, the Council could take the matter up with the California <br />Railroad Commission. He stated that the complaint would be givenprestige by be <br />I <br />eing backed up by the Council. Councilman Armstrong, seconded by Councilman <br />Fletcher, moved the matter be referred to the City Manager and a report made <br />at the next meeting of the Council. Motion passed unanimously. City AttorkTey <br />�1 <br />McCarthy stated that in the event an agreement cannot be reached with Mr. Martin, <br />he will prepare a petition which the Council can submit to the Railroad commission. <br />City Manager Mead reported on the progress of the acquisition of recreational area. <br />Negotiations have been completed on Lot 13 and the City now has possession of <br />the deed. Negotiations on Lot 15 areeproceeding very nicely and he expects to <br />have definite recommendations to make by the next meeting of the council. Council- <br />man Armstrong moved, seconded by'Councilman Fletcher, that the matter be placed <br />on the agenda for the next meeting. <br />Councilman Armstrong moved, seconded by Councilman McNulty, that introduction of <br />ordinance regulating issuance of permits be continued to next meeting. Motion <br />passed'unanimously. <br />Building Inspector Duncan reported on the matter of the abatement proceedings of the <br />t Lombardino property. He reported'that the building has been torn down. Council- <br />man Armstrong asked 'if the site had'been cleared, to which Mr. Duncan replied that <br />it had not been. Councilman Armstrong moved, seconded by Councilman McNulty, <br />that the matter be carried on the agenda pending final clean-up of the property.ul� <br />Motion carried unanimously. <br />City Manager Mead reported on second-hand. car lots and sale of used cars by ser- <br />vice stations. He reported that each dealer has one lot only and that he had <br />been unable to find any gasoline'station selling cars. There is a car at one <br />service stat16finwhich is for sale but T&161h is owned by the ab .lee station =p <br />operator. Permits have been issued to all dealers of used car lots and licenses <br />have been paid up to June 30. <br />M <br />
