R Councilman Armstrong asked if ordinance were passed at, this meeting and Mr. <br />i <br />Flynn sold the property, would the new owner have to present plans to the Council <br />„ for building? City Attorney McCarthy answered that it would not be necessary. <br />Attorney Nuckolls again stated that the Planning Commission has not had •time <br />to act upon the matter of an amendment to the zoning ordinance. He believed <br />property should not be taken out of fire zone until, Planning Commissiom has had <br />k an opportunity to study amendment and make recommendation to the Council. <br />i <br />Mr. Flynn stated that in regard to the recommendation of Planning Commission, <br />both he and Mr. Nuckolls appeared before the Commission. It was brought to <br />their attention and passed unanimously that property be removed from the fire <br />1 � <br />zone. He did not appear at the next meeting of the Planning Commissions, not <br />believing it necessary, but Mr. Nuckolls did appear requesting change in zoning <br />ordinance and it was upon the suggestion of Mayor Granger that the motion visa <br />passed that a let -ter be addressed to the City Council advising them of the <br />Commiss-ionis request. Mr. Flynn stated he had property which was outside of•.the <br />fire zone and on which,he could build multiple buildings if he so desired. <br />..Councilman Fletcher believed that Mr.. Flynn was entitled to some relief in the <br />matter and that. the .Planning Commission had made the recommendation that the <br />...: property be removed from the fire zone and, therefore, he believed the Council <br />should act in accordance with their,recommendation. <br />A Mrs. Skivo addressed the Council against removing the property from the fire <br />zone and asked the Council to proceed with caution. <br />Councilman Britschgi said he did not believe that there was any building.in- <br />volved in the matter and that it was merely a matter of moving the fire zone <br />so as not to include this property. <br />Mr. Flynn stated that there is no sale pending at the present time and if it <br />is possible he would be willing to have it inserted in the minute6 of the Counell <br />that if sale of the property should come about the .Council has, the right to <br />refuse to allow any building to be erected until the ordinance is passed one way <br />or another. •Said he believed the Council should have some right to instruct <br />the Building Inspector to refuse to issue such a permit. <br />.Councilman Britschgi believed this was the way the matter would have to be <br />handled. The situation has nothing to do with any building and the Building <br />�.. Inspector will have to Handle the matter according to the instructions of the <br />Council. <br />f Attorney Nuckolls stated that the whole affair was brought up because of an <br />} application being made to build multiple buildings on property adjacent to <br />this particular lot and, because additional land was needed, the request was <br />made to remove this lot from the fire zone. He stated again the .Council should <br />move cautiously before taking action. <br />Mayor Granger asked Mr. Nuckolls if he.believed the Planning Commission would <br />have a.. -recommendation ready to submit, to the Council at the next meeting, to <br />which Mr. Nuckolls replied he believed the committee appointed to draft an <br />amendment to the zoning ordinance would have something definite to present to <br />the Commission at its next regular meeting.
