Mr. Duncan <br />replied that they did not - the requirements call for a reinforced concrete. <br />structure and that the Diner was not a fireproof building. Mr. Scott said that <br />it was a steel building and believed it should be considered fireproof. Council- <br />man Armstrong said that inasmuch as this structure was originally a portable <br />structure he would be interested in knowing if a permit had been granted for thel <br />additional structure. .If so, he believed that would indicate that the -building <br />met the restrictions of that zone. <br />Mayor Granger said he believed it would be well to defer action on the matter <br />until the next meeting. Councilman Armstrong believed that since the action <br />,originated in the Planning Commission it should be referred back to them for <br />further reconsideration and moved that the matter be referred back to the <br />Planning Commission, the Commission to'contact the owners of the property and <br />give them an opportunity to appear before the Commission who could revi.ew.the <br />matter and then make an additional recommendation to the Council. Councilman <br />McNulty seconded the motion. <br />City Attorney McCarthy stated that°the Planning Commission did not have in mind <br />the change of ownership of the business and did not give consideration to the <br />additional brick structure. He believed if it were referred back to the <br />Commission, Building Inspector Duncan could check his records for the permit to <br />erect the brick structure and he believed the Commission would give further <br />consideration to',the matter. <br />Councilman Britschgi, under the question, stated the Council had made no defini <br />commitment either way and believed the matter should be laid on the table until <br />the time arises Schen some definite action is going to betaken. <br />Motion passed with Councilmen Britschgi and Hilton voting in the negative. <br />Pyr. Scott asked that it be entered in the records that because of the factors <br />mentioned his client does not agree that the Council has the power to revoke his <br />permit. <br />Mayor Granger saidhe believed this brought up the point that it was important <br />to have permits recorded. Councilman Armstrong stated he believed this was an <br />excellent example of the shortsightedness -of issuing temporary permits. <br />City manager Plead reported that he had received no recommendation from the Recreation <br />Commission iti,regard to request for funds by the Y. H. C. A., however, the <br />Commission does not meet until the f ourth Tuesday of the month and he believed <br />that he would receive a recommendation before the next meeting of the Council. <br />The matter was carried on the agenda for the next meeting of the Council.. <br />Councilman Britschgi said the matter of a report on location for used car lots had <br />been on the agenda for some time and that no meeting had been held on the subj <br />He moved that the matter be taken off -the agenda until some time in the future, <br />seconded by Councilman Hilton._ Motion passed unanimously. <br />City Manager Mead reported on the matter.of the Traffic Safety Committee's recommend- <br />ations for one hour parking on Commercial Way.
