the position of treasurer not to exceed $75.00 per month and the selection to <br />be made at a later date, seconded by Councilman Fletcher.` Under the question, <br />Councilman Britschgi stated he would like an opinion from the City Attorney as <br />T to whether the council could appoint a city treasurer when there already is an <br />appointment to this position. City Attorney McCarthy stated that in conformity <br />with the Charter there is a motion on record that until a separate auditor is <br />appointed by the council, the treasurer sh4l act as auditor. The motion <br />would automatically free Mr. Dodge who would cease to be treasurer and would <br />become auditor. Councilman Anderson stated that he would like a statement at <br />the next meeting As to the exact amount of work to be performed by the treas- <br />urer. Councilman Armstrong stated that all warrants and cash would pass through <br />the treasurer and that he would have some duty to perform every day. Council- <br />man Britschgi asked how this position would be affected by the civil service <br />ordinance, to which City Manager Mead replied that no part time employees are <br />civil service. Motion passed unanimously. <br />Mr. Roy appeared before the council in connection with application for permit to con- <br />duct a trailer camp by Mrs. Rose Roy on Bayshore Highway. Councilman Fletcher <br />stated that he had no objection to the camp if it met the requirements of the <br />health department and if it were operated under the trailer camp ordinance. <br />Councilman Fletcher moved that the permit be granted, seconded by Councilman <br />Armstrong. Under the question, Councilman Granger asked if the applicant <br />understood that the permit was granted on a year to year basis, to which Mr. <br />Roy replied that he understood the -provisions of the ordinance and that it was <br />the intention to conduct this camp only, for the duration of the war. City <br />Attorney MdCarthy recommended that the permit be granted to'June 30, 1945. <br />Councilman Fletcher amended his motion that the permit be granted to June 30, <br />1945, seconded by Councilman Armstrong. Motion passed with Councilman Britschgi <br />voting in the negative. <br />City Attorney McCarthy informed the council that the original agreement signed by <br />Mr. Emil Steinegger and his wife had been found with the following endorsement <br />on it. "Filed November 2, 19429 C. W. Eltringham". The agreement was approved <br />by F. J. Clarke and his civil engineer's stamp affixed to it. Mr. Clarkehad <br />a copy of a letter which he wrote to Bir: Steinegger in which hbeenclosed a <br />copy of the.agreement signed by Mr. and Mrs. Steinegger and made no mention of <br />it being signed by Mr. Heins. Mr. Clarke had informed Mr. McCarthy that if the <br />agreement had been signed by Mr. Heins, he was very certain that it would have <br />been mentioned in the -letter. Mr. McCarthy stated that unless Mr. Steinegger <br />can show a copy of the agreement signed by Mr. Heins, he believed it was Mr. <br />Steinegger's responsibility to repair the bulkhead:. Councilmen Armstrong re- <br />quested that the agreement be read. Councilman Anderson was of the opinion <br />that the city was not liable in case the bank should wash away in which opinion <br />City Attorney McCarthy concurred. Councilman Anderson then suggested that a <br />letter be written to Mr. Steinegger and the present owner advising them that <br />the city is not liable with respect to any erosion of the bank but that it has <br />
