1 <br />1 <br />`1 I <br />0 <br />was originally built, it mould have met the building code requirements, to which <br />Building Inspector Duncan said that it probably would have. Councilman Arm- <br />strong stated it was a question of fact as to whether or not the structure con- <br />stituted a separate dwelling. After considerable more, discussion as to whether <br />or not the structure was a separate dwelling, Councilman Fletcher moved.,that I;Zr. <br />Groenbach be granted the permission to let this building stand as at present in <br />asmuch as the Building; Inspector had said it would have been.allowed, if it had <br />been included in the original structure, seconded by Councilman Anderson. Under <br />:the question, there was more discussion and City Attorney McCarthy advised the <br />Council that he was not able to determine whether or not it was a separate <br />structure. Councilman Anderson suggested the matter be continued until the next <br />meeting to enable the Council to have a better answer to the question, and <br />withdrew his second. Councilman Fletcher withdrew his motion. <br />Mr. Scott asked if it would be satisfactory to the Council, rather than to <br />delay the matter, if the building were moved over and made a portion of the <br />common wall. He explained it would not be a full common wall. Councilman <br />Armstrong asked to see the plans. Councilman Fletcher moved permit he granted <br />as outlined by Mr. Scott subject to the approval of the BUldinG Inspector that <br />the structure becomes a portion of the house, seconded by Councilman Granger. <br />Motion passed uanimously. <br />Mr. J. G. Adams appeared before the Council stating that he rias acquiring a lot on the <br />corner of Hamilton and Fuller on erhich he wanted to _ operateean industrial machine <br />shop. He asked permission of the Council to do so. There was some discussion as <br />to the zone in which this piece of property was located and it was ascertained <br />that it was on the borderline of the second residential district, in which no <br />industrial business'is allowed. <br />Councilman Armstrong moved that appropriate action be instituted by referrix;g <br />this matter to the Plam-iing Commission with respect to rezoning this piece of <br />property, seconded by Councilman Anderson, with the idea that the entire strip <br />of land be considered. CouncilmanIIeNulty, under the qudstion, asked who would <br />pay the expense of the rezoning procedure. City Attorney McCarthy replied that <br />the applicant would pay for the post cards notifying adjoining property owners <br />of the proceedings. He said the expense of the publication of the ordinanceis <br />normally borne by the property owner unless the action is initiated by the <br />Council. I,2otion passed unanimously. <br />.1r. Vt. A. Van Buren appeared before the Council requesting; permission to conduct a usec <br />car lot at 332 El Camino Real. He said he had been operating such a lot at this <br />address for Mr. Cuddy for the past four years and as soon as it is possible for <br />him to obtain a new dealer's agency, he would build a $10,000 modern building. <br />He stated he would operate a model used car lot if he were granted the permit. <br />Councilman Armstrong asked if the ordinance required the holder of a used car <br />permit to be a new car dealer. City Attorney McCarthy replied that it did not, <br />that the dealer could either have a new car agency or pay a fee of $200 per annum, <br />end read excerpts from the ordinance.
