1 at the next meeting, seconded by Councilman AndetsonW Under the question, City Manager Mead advised that a claim had been submitted by Mr. Uhlenberg for #700, $600 being for the annual audit, which amount had been set aside in the budget for this purpose, and $100 for services and discussion in regard to the position of city treasurer and believed this matter should also be discussed with Mr. Uhlenberg. Councilman Armstrong believed this matter should be discussed separately and moved that a committee be appointed to discuss this matter with Mr. Uhlenberg. Inasmuch as there was a motion before the Council, Councilman Armstrong.withdrew his second motion. Motion passed unanimously. Councilman Armstrong moved that in respect to the additional $100 for services rendered by Mr. Uhlenberg that there be transferred from the contingent fund the sum of ?100 to the fund provided for auditing expenses to meet the additional cost, seconded by Councilman Granger. Under the question, Councilman Britschgi asked what the $100 covered. City Manager Mead read the claim which covered the annual •F audit plus miscellaneous accounting services rendered during the year including the report on the office of city treasurer. He explained that Mr. Uhlenberg had met with a committee of the Council in regard to the position of city treasurer and had rendered a written report on it. Councilman Armstrong said he believed he had rendered special services to the city auditor and city collector.. Mayor asked if in the future, under the new agreement, whether or not these special services will be included in the annual fee decided upon. Councilman Granger wai: of the opinion that under the new agreement Mr. Uhlenberg would be available for special services at no additional cost. Councilman Armstrong suggested that an understanding be reached upon that point also. Motion passed unanimously. City Attorney McCarthy advised the Council that Mrs. Lillie C. Currie had presented a petition to redone two lots back of E1 Camino Real and adjoining lots fronting oz - E1 Camino Real at the site of the Currie Manufacturing Company. He explained th,:t this matter should be referred to the Planning Commission. Councilman Anderson moved the matter be referred to the Planning Commission, seconded by Councilman McNulty. Motion passed unanimously. City Attorney McCarthy advised that at the sed'ond meeting of October, he was instructed by the Council to institute proceedings against Mr. Middlekauff, owner of the Bayshore Fertilizer Company, in regard to the abatezpent of said company. He saic' he had had a warrant issued against Mr. Middlekauff and that Mr. Edmund. Scott, attorney for Mb. Middlekauff, had asked Judge McNutt to defer arraignmentuntil he finished a trial, which had been done. Mr. Middlekauff has asked for a jury trial and the date has been set for December 24th. He explained that a jury trial would necessitate setting up $24- for jury expenses. He further explained that he had discuesed•thb.situation with Mr. DeHoff, who owns the adjoining prop- erty, and he advised that the fly situation had decreased, Mr. McCarthy asked i:� the Council wished to go ahead with the trial or if they would rather enter into an agreement with Mr. Middlekauff that,the premises would be cleared by the 15th of January._ He said that the Health Inspector Stein had inspected the premises again and that some of the material had been removed.
