of the opinion that it'would be better to enter into an agreement rather than have the jury trial and moved that the City Attorney be instructed to have the jury trial continued to the first available date after January 15, 1945, and enter into an agreement with Mr. Middlekauff that the premises would be cleared not later than January 15, 1945, seconded by Councilman McNulty. Motion passed unanimously. e Mr. Robert Gray appeared. before the Council stating he had received a message to be present at this meeting. It.was undecided who had so informed Mr. Gray but City • Attorney McCarthy advised the Council that',at the last meeting Mr. Gray had been denied a permit to put up a building at the location where the Diner is located. ' He stated that since that meeting, Health Inspector Stein had inspected the pre- mises again and advised Idr. Gray that the present trailer could not be tolerated. Mr. McCarthy asked if the Council would consider granting Mr. Gray permission to erect a structure with the understanding that it be -removed if the Diner were removed. Councilman Armstrong was of the opinion that if had been so agreed at the last meeting and asked to ha`s the minutes of the last meeting read in re- gard to this matter. City Attorney McCarthy read this portion of the minutes which stated that a permit for a permanent structure had been denied butthat Mr. Gray would be allowed to put up a temporary structure which would comply wit)i city fire and health ordinances. Mr. Gray stated he had some trouble in getting a contractor to do the work but that he had finally been abbe to engage one and that he expected construction to start in about one week on a fire proof tile building. Councilman Granger asked if the building had been posted to which` Health Inspector Stein replied that it had been but that proceedings had been held in abeyance pending the decision of the Council. Councilman Granger was of the opinion that regular abatement proceedings should be followed while Mayor Hilton and Councilman Fletcher were of the opinion that,carrying the matter on the agenda would be sufficient. Councilman Arm.strong moved that the matter be placed on the agenda of the next meeting for further consideration by the Council, seconded by Councilman Granger. Notion passed unanimously. Mr. Gray advised that it would,be necessary for him to apply for a building permit from the Building Inspector. Councilman Granger stated that in the monthly reports received from the City Collector there was no breakdown of the receipts from the Emerald Lake District and be- lieved these receipts should be kept separate from those of within the city. City Collector Miramontes advised that the accounts were consolidated. City Manager Mead stated that^this custom had been instituted over a year and a half ago because of the matter of bookkeeping, which cut out about 10% of the work in the department.. Councilman Granger was of the opinion that by consolidating the receipts it was impossible to ascertain whether the city was operating in the Emerald Lake District at a loss or profit, which opinion was concurred in by Councilman McNulty and Mayor Hilton.-. City Manager Mead advised. that a statement could be prepared at any time showing the operative costs, etc. Councilman Britschgi moved that the matter be placed on the agenda and a report be had from ` the City Manager as to the details of the work involved. Councilman Armstrong asked Councilman Britschgi to amend his motion to request a report from the City Manager as to the distribution costs and revenue from the Emerald Lake District for the fiscal year ending June 30, 1944, report to be presented at the next I
