Councilman Armstrong was of the opinion that that function fell on the city when the property owners Failed to do so and did not believe the city was asking the property owners to do anything that wag unfair. Councilman Granger seconded the motion before the Council and it was passed unanimously. Councilman Granger moved that the report from the finance committee as to their study of the auditor's report be approved and recommendations carried out, seconded by Councilman Britschgi. Motion passed unanimously. Councilman Granger quoted Section 77 of the Charter which states that no official of the city shall have any interest in public contracts and said he believed such a condition existed on some of the commissions and named two members of the Planning Commission to which this might apply, one an insurance broker and the other a city employee. Councilman FletchEr stated that in defense of the insurance broker he writes the insurance for the city but the commission is placed in a pool and all insurance agents in the city receive their share. Councilman'Granger moved that the matter be turned over to the City Attorney for his opinion at the next meeting, eeconded by Councilman Armstrong. Motion passed unanimously. Under the question, Councilman Granger asked for clarification of the Union Paving Company bill and stated that he did not believe all the gutters had been filled. City Manager Mead replied that all except three'. gutters on Brewster Avenue had been filled and that they were to be filled within the next f-ew days. He also said more work had been involved than had been figured on. Mayor Hilton asked if this were the final payment to which City Manager Mead replied that it was not, that 100 of the payment had been withheld. Councilman Granger asked if the streets around the Court House did not need a seal coat. City Manager Mead advised that that had been deleted from the contract and was to be applied later on by the city. Councilman Granger was of the opinion that contracts shou:.d be let on a lump sum basis rather than on a unit price basis. Motion before the Council passed unanimously. Councilman McNulty offered adoption of resolution adjourning meeting in memory of George A. Merrill, which resolution was to be spread on the minutes and members of his family notified of the Council's action.
